Another example of this, A-1 Magicalmedia used to do "Best Of" type tapes. The effects on these tapes were "leftover" effects from each particular performers videos. Since A-1 owns all of the video tape, they can use these extras and produce these "best of" tapes with the left off effects. Same kind of idea. Hopefully your converstaion with Magic Makers will come out in your favor later on. S.Segal |

But is a download video different from DVD video? It's the same video, just a different format. This was actually the main point on my mind when thinking about this problem Chad. I'm not sure what legal precedent there is. It would be an extremely intriguing to see a case arguing whether or not DVD and a distrubutible computer file are considered the same data even if they are the same video. What would happen if they took the 1's and 0's of the computer video they have, and print it in book format? So someone could reproduce the video from that book. Same video, different media? If they don't own the rights to the material, and only the video media, then they probabably have the right to split mind bender into 3 dvd's, but I don't think for sure that they would have the rights to transfer it to a PC-file medium. Find a specialist for a lawyer for sure if you want to pursue this.... although now that it is "out" there, free for anyone to download(all the penguin downloads are popular on kazaa and other networks), there has been un-fixable damage if you can prove its a different medium. Keep us informed Chad!!! |

Well, I just talked to the people at Magic Makers. As it turns out, there is somebody who plans to market this item in the near future and thy got wind of it. And so were trying to be proactive and re-release the original first. They appologized for not consulting with me and so we talked and worked it all out.
Please don't think anything less of Magic Makers because of this. They were just trying to protect their original investment and me from being ripped off. Now, everyone is on the same page and everything is A-OK. Thanks again to everyone at the Café. And please support me buy getting the original when the ripoff hits the market. Chad |

Wow..
MM is getting ripped off.. Now that's something very hard to digest. Infact its giving me constipation.. With the reputation they have, I seriously doubt their claim... I think they were telling a lie..
To believe is Magic.

If he was so concerned with "someone" releasing the routine, why didn't he do an all out advertisment for the DVD, not a download? Guess only time will tell. Also, concerning the routine itself, would someone actually re-release it "move for move" (in the main stream at least)? Its a coins across with some other common coin moves mixed in. If someone wanted to release this, all they would have to do would be to change up the handling, possibly drop a phase or add one, and credit. That would be more efficient that what Magic Makers does with most of their products. IMO |

Please don't think anything less of Magic Makers because of this. Don't worry, I don't even think that is possible at this point. |

I can reccomend the DVD! It is fantastic. I've modifyed the rubber band trick and it works great in my band routine. The holy grail is brilliant, Once you can get the catch you will be envyous of every magican that can't do it. The spoon bend is great and I combine it with liquid metal because the bend is so visual.
Go and buy the orignal. Matt |

Penguin and Magic Makers are affiliated with each other. Magic Makers has their own portion on Penguin's site selling their products as well.. Chad, I still find it a little awkward. That is not, of course, saying it isn't true... but...

Hi Guys,
Maxwell here from Penguin. We have no affiliation with Magic Makers other than the traditional manufacturer/retailer relationship. In this case we liked Chad's trick so much we purchased the right to sell it as an Instant Download. We make deals like this every day. Since Chad had already sold the rights to the footage we didn't contact him. We contacted the company that owns the copyright on the footage (Magic Makers). The law is very clear about issues of copyright, and everything about this deal was 100% legal and ethical (if you follow Penguin politics you'll find that this is a common theme). But, we're always glad to answer any questions. Best, Maxwell Murphy Penguin Magic P.S. I'm in NYC right now. We just got done shooting a new Instant Download with Oz. It's a Peter Eggink effect, and it's FANTASTIC! Should be out sometime next month. |
