I read on another board that Quarter thru Soda Can is available for rent at zip.ca, a DVD rental site like Netflix. Something interestong also came up. I checked some of my other magic DVD's and they clearly state "NOT FOR RENTAL". I didn't see any such thing on Angels DVD. It makes me wonder what his intentions were/are.
I paid full price for both DVD's and now find out anyone can rent them for free. Apparently there is no problem in the Chris Angel camp, as someone who works very closely with Criss on the show said "Why would you blame Criss? The company probably just ordered some copies like anyone else." Using that logic, I am putting my entire magic DVD collection up for rent. Get in line. I would imagine Criss has the ability to stop them from renting it, unless of course that was his intention, hence nothing on the box saing "NOT FOR RENT". I should have saved my $100.00 on the levitation and just rented it when it's available. After all, if they are renting out voulume one with no objections, why stop there? The scary thing is that if it catches on, perhaps other magi will start to allow companies to rent their DVD's so kids that rented the DVD can bust you when you do an effect. I hope someone can get Criss to comment on whether he condones this practice. |

I don't think he rented those cause he would sabotage his own business. What he let people rent is: Criss Angel Mindfreak: Season 1 2 discs seires.

I don't actually believe printing NOT FOR RENT on your DVD has any legal standing, at least not in the US. Once purchased, I would imagine that renting would be considered 'fair use', it would be up to the store if they wanted to respect the creator's wish.

Same in Canada. Our public library has the all Michael Ammar and Darryl tapes/DVDs. Most clearly say "NOT FOR RENT"

I think the "Not for Rent" could be used in a legal argument. Since it is intellectual property, the owner does have a say in how it can (or cannot) be used to various extents... Movie rental stores used to have a samilar issue when new videos came to market. It used to be a movie video would be released for rental only (and not for selling it out right for the first few weeks or months) unless you wanted to pay $100 plus for the video tape (and sometimes you had to be a dealer).... This eventually changed as a way of practice.. However, if you buy a movie from Walmart or Amazon today, you still can't go and rent it out or make any other money off of it... The disclaimers tell you that it is for private/personal use only..
With Criss's videos and library copies, it would be up to whatever disclaimers and copyright statement come legally with the product.. Not for rental could be used as a legitimate argument. The only way I can see arguing against it is if the owner (Criss or a legitimate partner who had rights and authority to convey rights) specifically authorized a particular use or failed to defend the use if no preferences or rights were specifically stated. Since Criss authorized the use of his footage for public consumption on television that material could be copied (TiVo'd , recorded, etc) from that source (but not sold).. I wonder if one of his producing partners has rights or authority to allow the kind of usage through netflix, etc. By the way, here is another site that is renting magic. I have a couple of these DVDs, and I will check them later to see what disclaimers they have.... |

The library issue is different than rental, since people are not paying a third party to use the video/dvd (someone else's intellectual property) when they use the library's material. The US has certain laws that saw that any "publication" released in the USA is subject to "mandatory deposit" in our public libraries and the rules go on to say what is a publication and what isn't.... here is link...the doc is long, but once you open the link, just do a CTRL-F (to do a search on the webpage) for the word "library"...

Yes, Yes, Yes, I do understand all the legal aspects of this discussion. However is it morrally right? He distributed this material to magis in hopes of getting some revenue. Once he did recieve what was expected the peak of revenues of magis he then distributed this as a rental. If that's not exposure please correct me. I know that this will be direguarded among the few and elite in this message board.
And I do mean the few and elite. There are a few on this board that have responded to questions of this sort and I, and a few others appreciate that.

Morally right? By society's morals or individual morals? Society's moral's are eventually translated into law...so the legal aspects of each society would answer your question as that level... As far as individual's morals go, we can only answer for ourselves (and even some people's morals would find argument with that statement... thus proving my point).... However, as a society, we generalize our morals and they usually translate to law one way or another...and are ever evolving....
You made a statement that "he" ( I am assuming Criss) decided to distribute it for rental..... I don't think this has been established as fact ...at least not in this thread so far ... so to make a judgement about exposure would be premature and possibluy accusing an innocent person of an action they know nothing about.... The question was whether a third party was exposing Chris's material and what we thought about that and whether it was legal (or not)..... |

Does a library in a free society have a right to order any published material they wish to make available to their patrons?
