About a year ago Jules Lenier sent me all of his books. I was to take from the the best of the best, and release it in a series titled, "Jules' Gems". The books are finished. Now that he has passed away would it be in bad taste to release them or would it stand as a tribute to the man to release them?

I second Jaz. A request is always important. A book is surely a great tribute . . .

Not sure about the financial side - but if this is on your mind, you might consider donating the income or involve Jules family.

Find out who is responsible for the estate and get them involved. Don't do anything else until you get a better feel from them. If they don't contribute anything novel, or give you any last-minute advice/directions, follow the original plan. Do your best. Good luck.

I agree with Patrick. Gene Poinc sent something like 10 years of columns into the Linking Ring right before he passed away, knowing that he would be unlikely to see more than a few of them, at most, published. Phil Willmarth is honoring that agreement. I know that Gene left a few of his illustrations to a friend, but I don't think he had any relatives.

If Jules' estate will allow you to publish this material, by all means, do it. You would be honoring his memory to do so.

I also agree with Patrick. Make sure to get the estate involved. It might get finnicky as far as proceeds are concerned, so best of luck.

Jules never sent the material to you to republish. He gave them to a shop in San Diego to republish. You may have been involved, but the request was not directed to you. It was directed to the shop.

You bring up two standard arguments in "ethics" within magic.

1. Everyone does it.
2. Famous people do it.

I think I can do no better than to use Max Maven's words in a March 1993 Linking Ring Essay:

That being said, it is not my intention to turn this thread into an ethics argument, and will leave the bulk of that argument to others.

My intent is to point out Mr. Eldridge is not in an appropriate position to publish material other than the fact that he never returned the material to Mr. Lenier when requested, and Mr. Lenier conveniently died, thus stopping requests for material.

If only bill collectors would die so conveniently.

All of this information can be verified with other magicians and members of the Magic Castle close to Jules.

Certainly, a share of profits should go to the estate. Jules has a daughter and other family still living. I would think you should check with Debbie for permission to publish at the very least. Anything else would show a lack of respect.

I have a large book from Jules containing 65 routines and effects. It's written in his classic style with lots of anecdotes and connecting narrative. I have a hard time imagining that he gave someone else permission to cherry pick routines from his booklets and publish just those when I have an entire manuscript here that has so much more.
I will be publishing the manuscript as an e-book and giving it away for free to all Genii subscribers.

I wish you could get a hold of the Jack Birnman book while your at it.
