The illusion I was building for a client was picked up over the weekend. He loved it; you might like it, too. It's "The Blades Of Opah" as conceived by Harbin then built by Stone, and may be seen by clicking below:

Leland that is one fine piece of work! I don't care if the other guy did commission it, I'd have a hard time letting go of something like that.

Pardon me but did John Gaughan release the rights to make this effect? The rights were clearly and exclusively given to John as documented in the Eric Lewis book.

The book says that the exclusive rights to manufacture the illusion and to publish the plans were granted to John. Since the plans were published in the book, isn't it fair to assume the publishing rights were granted to Lewis by Gaughan?
Things are more like they are today than they've ever been before...

Good question.
My understanding was that the owner of the manuscript was purchasing the right to use the material contained therein for his/her own personal benefit, excepting, of course, commercial manufacturing (in this instance, that right was transferred to an agent with the necessary mechanical ability to fabricate the piece). Since Gaughan had exclusive rights to publish these plans, and since the plans are indeed published, the question is really, as amosmc alluded, "Did Lewis have permission to include them in his work?" The burden of proof rests upon the claimant. Is there evidence indicating that Lewis published inappropriately? |

There is no burden of proof here. Reread the book. The rights are exclusive to John Gaughan who allowed the workings to be published. He did not release the rights to make them. He was trying to give credit to Harbin for this effect as it should be.
To quote the book exactly "A mentioned elsewhere, we cannot ethically give the details of certain Harbin illusions that were designed after the publication of the Magic of Robert Harbin. In the case of the Blades of Opah, however, the sole rights belong to John Gaughan of Los Angeles and John has given his permission to have his version described here." I fail to see where there is any question at all why this only to be built by John Gaughan. Richard

Had Lewis published a score or cookbook by Harbin (embellished or co-authored by Gaughan), then there would have been no discussion had I played the piece or prepared a meal based on Lewis' writing. The purpose of publication is to disseminate knowledge, and in the purchase of a work (such as a score or cookbook), the buyer is expected to make use of the information. Further, every person involved in the production of a for-profit publication anticipates this end use by the consumer.
I fail to see how the publication of a Magic text functions differently. To claim after the fact that published information is proprietary to the author and ought not be used by the buyer of the publication is simply a contradiction in terms. But Oprah has yet to weigh in on this on, so the jury's still out... |

Looking a bit further back on page 315, Mr Lewis states "... the sole rights belong to John Gaughan of Los Angeles and John has given his permission to have his version described here."
I think this statement, along with the previous one, pretty much gives you as an owner of the book the right to use the plans as long as you don't manufacture the illusion for general sale.

I always found this illusion to be VERY similar to Thayer's "Simiters of Bagdad" where three blades are pushed through three sets of stocks. (Picture three Lester Lake blades being pushed through three stocks.)
