I am doing a big college show next month and I want to tape my show. But the organizer says that if I tape the show, she is afraid that students won't show up and that if I do tape it I need release forms. ( I am doing 3 shows in 3 nights, probably 100 at each show.) This is my alma mater, so I know the school really well and in the past I have taped my shows without any problem. It is a free event to the students, so it isn't like they are buying tickets. What should I do? Not tape the shows? I don't want to find every person who comes to my show and have sign a release form. The tape is for my personal use, it isn't going to be aired on TV.

You're a bit late getting the easiest solution. My own contract has a clause (which no one has ever objected to) that says "4: RECORDING — You are welcome to record, photograph or videotape the performance at no additional charge. Performer or his assistants may also record, photograph or videotape the performance, including audience members, without further permission or compensation, both for performer’s personal files and for use in promotional materials." Is it legally airtight? Will it hold up if some audience member sues you? Maybe, maybe not. But it shuts up the host.
Second-best - when I visited Atlantic City, and the same I'm sure in Vegas, the showrooms all has what looked like permanent (inconspicuous) signs at the door advising that any performance might be taped for broadcast or other use, and that entry thereto constitued permission. I guess those who objected could decline to enter and maybe get a refund. Again, legally airtight? Maybe, maybe not, but certainly enough to use as a factor to scare away frivolous lawsuits ... "you were perfectly aware that the show was being recorded, and the judge will throw your case out the minute he quits laughing." |

Thanks for the heads up... I just added the recording part to my contract so for future gigs it won't be a hassle.
