Need a little input from the Café' community. What do you folks think?
I was recently made aware of the Modern Art design shown on the Tora Magic Company website: http://www.toramagic.com/htm/comic.htm Looks remarkably like the one my company built, doesn't it? http://www.AmazingEarl.com/SmokyMtMagic/......ghts.jpg Odd that the base of their image is chopped off...right where our logo was located. Could it be a coincidence? The custom artwork they did looks amazingly familiar. I wonder if they simply hired the same airbrush artist? Nope. That's me. I'd remember. Of course, the grille design is different on their version -- obviously digitally edited since the side angle is wrong and the lighting doesn't match. The girl also seems to cast no shadows on the prop...but I digress. We also completely re-designed the mechanics of the knife gimmick to allow for that much wider, themed blade. Since we posted no photos of those inner workings, I'm curious how they plan to accomplish that sight unseen if anyone decides to order one? International lawsuits for copyright infringement are expensive and complex, but I've defended my rights successfully before. Do you folks think I should contact my counsel...again? I'd go after him full steam. Or maybe first just politely ask why everything in the pic matches, to every little detail of painting, and see what he replies. This in a way tops them all!

This is certainly a shame...Dan's creations are 100% original!
I have two of Dan's custom illusions...a Kub Zag...and a custom prop he built just for our show (and a third custom illusion on the way!)...his work is THE BEST I have ever seen! HIGHLY Recommended! Hopefully Tora will remove your artwork! Cody S. Fisher

In any case I hope the Café that claims to support ethincs will not allow advertising from the company on this site.

This is obviously Dan's prop with a little Photoshop touch-up work. Even someone with an airbrush couldn't match the details exactly. This is a very sad example of ripping off another's work. Dan's version of the Modern Art is a work of art itself. It just seems that outside of the U.S. anything is fair game.
Let's do all we can to support Dan and his company Smokey Mountain Magic. I too, am a satisfied customer. Steve |

There was a big round and round between our Tora (Ozlen Tuncer) and the Tora you see in TLR. The whole thing is very complex. It seems that OT has had a very successful career, until the other one started doing everything he could to confuse the issue. Part of it is based upon a confusion that occurs when Ozlen's stage name (Tora) is set beside the transliteration of the other fellows name from Farsi (Toora). Well Tura, as he used to spell his name, decided to exploit the transliteration fuzziness, which also permitted him to transliterate it as Tora, adopted Tora's mode of wearing his mustache and beard, and made things very difficult for Tuncer.
I tried to get Phil Willmarth to do something about this, but since there was no concrete evidence against Tura/Tora, he couldn't do anything about it. Now, we have proof, that Tura/Tora is knocking things off. Go for it! In today's political climate it is not a good idea for people in the US to do business with people in Iran. There are other magic companies operating out of Iran, as well. Since their government does not recognize our intellectual property, and their president doesn't want us to remain alive (and he takes his orders from a voice in a well that only he can hear) I think we should avoid doing business with them.

Some of those illusions listed on Tora's page are knock offs of knock offs. Wow!

UPDATE: Tora Magic finally responded to me by email, apologized profusely and have now removed the photos of my prop from their website.
They also explained that the images had been sent to them by a European Illusionist; an outspoken Café Member AGAINST intellectual property rights, by the way. This source told them HE had designed it and thought they should build and market his design. Obviously, he lied. So, a public "Thank You" to Tora Magic for clearing up the misunderstanding and doing the right thing in regard to this matter. Dan Wolfe Smoky Mountain Magic |

Hi Dan, I just received an email from Tora Magic about a Modern art and they seem to STILL be selling it with your design and ideas. It is almost exactly the same. Apparently now they are selling it in four different colors, one of them being the exact design you have, with the lamp and everthing as in the picture you posted in your first post. Anyway, just letting you know and hopefully they remove it. It might not be listed on their site, but they are sending emails with your modern art.

I didn't see it listed on their site, but I guess if they're sending emails trying to get people to buy it, it must be. I'm glad this thread started because I was actually going to buy somethings from them, but not anymore. Dan, If I were I'd take this to a more serious level now that they STILL have it listed on their site after talking with them about it.

This is a reply to all the charges and problems about me and my company. I am really sorry about all different sorts of misunderstanding happing between us to this extent. I like both American people and American state. I always feel proud of liberal opinions and the respect you have towards other nations. To me you are the status of freedom to other nations. I was so surprised, when I have read your opinions on me and my products. I am an Iranian magician working in Thailand and Singapore who sometimes travels to Iran. Persians honestly like American people and they are really hopeful that our future relations would improveI am attempting to do my business in the best way possible. I am a member of IBM association who works with many professionals. I had traveled to many international festivals to keep my company up to date and to offer the magicians better products for better performance. It is unbelievable to me to copy other people’s designs. Moreover we are aware of copyright rules and also respect them. Our primary policy in Tora magic is to design and produce new items on our own designers. We also occasionally have new designs on classic items or take some hints from other items. But it is not a copy at all. I would like to have a better friendly relation with you and I would do anything possible to prove my honesty. I have registered Tora magic company both in Thailand and Singapore and am ready to serve customers for further cooperation. I believe the primary duty of us as magicians is to support our community members in any way possible. Do not you think? Regards Tora |

An Open Response to Tora Magic....
This is my first post here on this venue. I would probably not have added anything to this thread, but I am compelled to as a result of your missed understanding of what is being said here. I do not believe anyone here really cares if you are from Iran, Pakistan, Thailand, or even if you are an American. The issue is not your race or nationality, but your character (or apparent lack of it). The messages in this string show one theme, again and again….you are manufacturing and selling intellectual property that does not belong to you, and perpetuate this even after the rightful owners ask you to stop. On your website you have many some interesting looking (and probably original) props. I think you can make an honorable impact as a magic dealer with originals. However, there are also many props on your site are blatant Rip-Offs of intellectual properties that do NOT belong to you. Yes, you can build a prop and add your own twist to it, but only after you have the owner’s permission to do so, unless it is in public domain. The props in question are NOT in public domain. You can market a cola soda, but if it has a red can, and white lettering in the same font as another well know brand , you will be taken to task on it, sued, fined and prohibited from further distribution, even face jail time. Why….because it is illegal to do so. Said differently…..YOU ARE STEALING!!!!!! Your claims if originality look laughable when you see items such as a fire to dove cage that is obviously a rip-off Richard Hughes’. It also appears that you have decided that the sole manufacturing rights for the fastest trick in the world (as and even his original flower design which is a hallmark of Hughes magic) do not apply to you; as long as you are in Iran…I mean have a fronting (paper) company in Thailand. In Iran, if you steal something, they used to cut you hand off for it! Mr. Tora…Stop Stealing! These items do not belong to you. Do not try to justify it further, just STOP IT! If you are branded a thief, scoundrel, and rip-off artist, you will sell less and less. If you are original, and build quality props, you will sell more and more. The choice is your. Regards. M. |

"Tora, Please cease and desist from manufacturing the Fastest Trick in the World (Vanishing Bush & Pot)(shown as the “Super Vanishing Bouquet & Vase” on your web site). I hold the exclusive manufacturing rights, as well as right to grant performance with the purchase of AUTHORIZED versions (which yours are not). Please cease and desist from manufacturing my Dove Production Cage (shown as “Automatic Fire Cage” on your website). This is my original creation, and I hold exclusive manufacturing rights, as well as all rights to grant performance with the purchase of my (the only authorized) version. Additionally, your new flower design very closely resembles the established hallmarked look and design of my blooms. This appears as an attempt to deceive the magic consumer and wrongfully make your products look like my products. You can make all the magic you like, including flower effects. In fact, some of your original effects seem very innovative. But items that are my intellectual property or are constructed so they look like mine are not to be infringed upon or manufactured without my express written permission, which you do not have.
