Yeah big Whoops, Dan and I are looking into this to see how the 2 products compare. Neither Dan or I want to take anything away from Jerry Somerdin so we will do what we can to find a solution if the products are the same.

These things happen. All the time. Sometimes with the intent to steal (um... TAC TIC). And generally, imo, with no malicious intent and no prior knowledge of the similar effect. Even with a lot of research, it's very tough to know everything out there. It's clear from Dan's humble presence on this forum, he has not intentionally ripped anyone off. Mr. Somerdin, it seems you understand this, as you should. Does 'DEVILISH DECEPTION' ring a bell?

It should be noted that there is no side by side comparison yet to tell the difference in quality and ease of use between the 2 gimmicks. Jerry's is cheaper, we don't know if they re the same quality and we don't know if they offer the same content. If they are the same then we are not going to pretend like Jerry doesn't deserve credit he does and obviously there has to be some similarities. The real value is not the gimmick, it is the possible applications of the gimmick and that is what Harlan offers here, I love the gimmick but I have used it for so much and based on just ad copy and demo's you get a lot more for the extra 10bucks. What was once a pretty cool packet trick is now taken to completely new level and that is what is great about our industry the combining of minds to push things farther and farther. This does not give people the right to release others effect without their but this is not the case here, this is an obivious case of independent creation and if the 2 are found to be the same then we will work hard to let people know who the original creator is.

I don't care about Perfect Monte, never even heard of it before. Dan is a professional on so many levels. And, a classy guy!

I sent the JS version to Dan in Mondays mail, he will then be able to make a perfect comparison think you will find them to be nearly identical, certainly the method is, However , with Dan’s version you do receive a downloadable video that offers some great routines with decent quality tutorials as well.

Yes, after Randwill's post I checked out the demo of Jerry's Perfect Monte at Fantasma. I was surprised to see the similarity of the gimmick, so I tracked down Jerry's number and called him about it. Turns out that I have essentially re-invented his gimmick. Although there are a couple of technical differences in design and manufacturing, and I've utilized the gimmick in multiple ways, both gimmicks accomplish the same thing in basically the same way.
It bothers me when this kind of thing happens. I have been on the "receiving" end of similar situations a few times before so I know how it feels. So, as mentioned, I'll never make or sell any more of these. Once these are gone, they're gone. AND I'm going to SPLIT MY PROFITS with Jerry. Perhaps unheard of, but I feel it's the right thing to do. As a creator of magic, I feel creative magicians deserve to be compensated for use of their intellectual property, even post facto! Lorem ipsum! So... if you want a "Perfect Monte"-style gimmick (handmade by Dan Harlan) complete with a DVD full of ways to use it, then get a "Switchblade" before they're all gone. If you just want the three card trick, save some money and get "Perfect Monte" (handmade by Jerry Somerdin). Either way, Jerry Somerdin gets the credit and some cash! --Dan Harlan |

Unless Jerry shared his profits on Devilish Deception (what most people claim is a direct steal of Eye to Eye) with Charles Gaucci I don't think Jerry should accept a dime from

Well ,you can feel that way, and I might understand it.
But this gets us into "do two wrongs make a right?" territory. I think Dan has shown with this that he is a VERY big man. If others aren't as big as him... well it just makes it all the more impressive.

In the long run, they don't.
There is a book I have bene trying to track down for ages called "How nice guys get rich." or something like that. Its author argues that good ethics are good business because, in the end, business is mostly about relationships and all industries are small ones when you get into the ranks that matter. Go around making enemies and you wont survive long at the top of ANy business, go around making friends and you can. I grant you that there are some notable exceptions (Larry Ellison comes to mind in my business) but they are notable because they are exceptions.

Dan, first you are a classy guy. I have so much more respect for a person who, when they make a mistake, just admits it and move on. Stuff happens. I get the sense, as it seems do most others on the Café, that this was simply an incident of independent creation. Jerry, by your own admission created this gimmick first. But it seems that you have taken the gimmick and expanded the possibilities for it's use and added something of value in the way of routining, multiple uses and it seems, excellent instructions.
I would offer that you and Jerry should agree to continue to let switchblade be produced and just share in the profits. Jerry clearly has to be alright with this but I think that your minor additions to gimmick and major additions the routining and effects that this gimmick can produce should be allowed to stand. It is a benefit to the Magic community as a whole to allow your creative thinking on this to be shared. I think you benefit by receiving some compensation for your work, Mr. Somerdin receives compensation for his original idea (for little if any effort btw, which has got to be nice) and the magic community can continue to benefit from the creativity of our talented magicians. I think that would be a equitable solution to the problem. Of course that is only my opinion but I'm going to put it out there because I think there is some merit to it. So what do you say Mr. Harlan and Mr. Somerdin?

So Jerry - how about you just let Dan go about way and continue making Switchblade, while you continue with Perfect Monte? Some people will buy Switchblade, some will buy Perfect Monte. That, my friends, is called consumer CHOICE. |

I have to agree fully with everything you have said here. Switchblade is a great utility device and that is what Dan created. Perfect Monte is a packet trick. With Switchblade you get a video download of instructions to perform some amazing effects with the card. I personally love the ghost routine using a full deck of cards, and when the magic happens right in their hands it is brilliant, this is not a packet trick but a full routine. You also get to see Dan working his gimmick card to strangers. So although the same gimmick was created individually the applications are vastly different from one creators mind to another. Credit Jerry in future releases but to stop expanding on this effect I don't agree with. Just my thoughts,, Love the new release Dan..
