Been watching this documentary between studying for a final. It's really interesting. I have to say that it has completely reversed my opinion on the original McD's hot coffee story. I plan to read more about this when I have time.
I wouldn't try to tell anyone else what to think. I recommend watching the film, doing the research, and deciding for yourself.

I actually learnt a lot about the full story with regards to the McD's coffee incident after my mother's car accident, and my parents ensuing never ending dealings with insurance companies afterwards.
I had actually worked on a proposal for a documentary focusing on similar stories and how many, even when they "win" are completely screwed in the end when dealing with insurance companies.

It's amazing how badly burned the person was. The pictures are certainly NSFW. So many people use that as an example of frivolous lawsuit, when in fact it was far from it.

I used to think it was frivilous, too...then I studied the case about six times in college. Not only was it warranted, but it also changed the way the industry is run. The coffee makers have regulators in them to keep the temperature from rising over 160.

I never thought it was frivilous. And I never understood how anyone would think suing over something that caused third-degree burns could have been frivilous.
I understood Mickey-D's point of view which was people getting their coffee in the drive through want it to still be hot when they get to where they're going, but they had to answer for the ramifications of that.

Ed, the reason people thought it was frivilous is, they didn't know that the woman received 3rd degree burns from it, and thought it was sheer ineptitude on her part.

A documentary can present a slanted view just like anything else. All you have to do is look at some of Michael Moore's work.

True. But the facts were overwhelmingly in the woman's favor. As has been noted, the case resulted in a complete change in industry standards.

Hrmm, I too am unfamiliar with the details. However - if you order Hot Coffee and the lid and the cup are intact and not faulty then I REALLY don't see how McD's should have been held responsible.
If I feel so inclined I'll look it up.

There was also a ginormous list of previous injury complaints from the McD's coffee shown in the doc. That's why I recommend seeing the film and doing research before coming to a conclusion. All available facts should be considered.
Although, for me, it was the photographs of her injuries combined with McD's on top of the other facts that really sealed my change of opinion. I do notice that Starbuck's always warns that the coffee is very hot. I wonder if that's related to this case?
