Hi guys. I just wanted some fellow magicians opinions on a topuc. I know of a magician on the Café that is buying dvds, making copies, and then selling the original to regain part of the purchase price while retaining the copy. I know that this is illegal to do because it violates the DRM. However I was wondering how others feel on this topic. I feel it is morally wrong to do because it takes money from the magic creators we all patronage and gives them less of a reason to produce more for us. What do you think?

Mr. Mystoffelees Inner circle I haven't changed anyone's opinion in 3623 Posts |
I think it is morally wrong. When I buy an effect, I believe the creator has sold to me the right to use the effect as part of my magic routine. I even have no qualms about recording a copy in case the original is damaged or destroyed. To recover the cost on the back of the creator, however, I feel is wrong.

I agree whole heartedly. I'm surprised others haven't chimed in with opinions one way or the other.

I think it is just so clear nobody wants to bother saying. I can't imagine anyone baling the pirating of material.

It's not only morally wrong, but it is a crime. If he is making these sales on the Café he is in violation of Café rules as well and should be permanently banned.

I agree but I talked to Café staff and they said since he is selling originals it's not in violation of Café rules.

Obviously illegal; obviously unethical.

From a legal standpoint it's not illegal in most parts because it is lawful to resell dvd's, books, etc.
As long as the original dvd is being resold no crime is being committed. Apparently what he is doing is making himself a copy and selling the original. If he sold the copy he would be in legal trouble. Keeping a copy of a dvd while re-selling the original is not illegal but some if not most in the magic community will say it's immoral, unethical, stealing from the creator, etc, it's all crap. lol Sounds like he was honest enough to acknowledge that he burns copies for his own use and then resells the original. If you think it's unethical of him then don't buy his dvd's. Some don't think it's unethical.

"Keeping a copy of a dvd while re-selling the original is not illegal"
I don't think this is true, at least in Europe. Can anyone clarify? I always thought it was illegal to copy a DVD for yourself then sell the original? In the UK it might even be illegal just to make a back-up copy without selling the original: http://www.express.co.uk/life-style/scie......-Illegal Even more info - its a minefield: https://en.wikipedia.org/wiki/Ripping#Legality |

This seems clearer for US folk:

It's not illegal in USA and Canada to make personal copies. It is illegal to sell the copies. Not illegal to sell the original and keep the copy.

He didn't but is technically right. The copying of the dvd isn't illegal it's breaking through the protection software. Which you must do to burn a dvd. So it's still illegal by proxy.

Also I was wondering how some can morally justify this type of action as was stated above?

One doesn't. Why would they have to. People have different morals and belief's. What's not right for you might be right for others.

I was wondering their logic. Just because someone believes a certain way doesn't make it right.

Just because someone says it's wrong doesn't make it wrong. What's the logic of trying to push a certain set of morals onto others? Morals are subjective. I find it immoral that some magicians use moral and ethics as a bullying tactic to force others to comply with their set of morals and ethics. Not everyone holds to the same morals and ethics, it's just that simple. In the meantime laws are constantly being broken by magicians especially in business ventures.

As far as morals and ethics go you live in a place with the morals and ethics you believe in and frequent places that are the same. We live in a society for a reason. Not just for everyone to be able to do what they want. Just because someone has different morals and ethics doesn't make it right and doesn't mean that they are justified. I believe it's wrong to prey on children. Are these people with different morals and ethics right. I say hell no. However according
