If we combine methods do we make a NEW effect? And if so, can we market the new effect as our own?

Methods are not effects.

No. Magically speaking, the effect can be accomplished through the method. But what my question is, can we combine methods to create a new effect and can that effect be marketed? Hopefully that's more clear but maybe not?

In my opinion -
Check with the creators of the original methods to see if they mind. If they are not alive or able to be contacted, check to see if anyone else holds the rights to those products. If no right-holders can be contacted, then you're probably fine. Clear crediting is obviously appropriate in any case.

... can I mix a Snickers bar with Haagen-Dazs ice cream and market my product?
I still recall the day I met Beaker from the Muppets. He said to me "Meep, meep, mee mee mee Meep!", and that has made all the difference.

None if us know what they do and do not pay for exactly. I'm going to doubt they don't pay the people who should be paid. Also they do not use Haagen-Dazs ice cream but rather their own.

More to the point, the actual question asked is:
If I use different pans, and cook on magnetic induction rather than gas flame, and I use a food processor instead of chopping by hand, is my asparagus and mushroom risotto a new thing I can call my own and sell? Methods are not end products. |

Okay, let's look at it this way.
Cody Fisher markets his 3 Ropes And 1000 Laughs, a comedy version of Professor's Nightmare. No new methods, but the script and the routine are his. Is this okay? Pop Haydn sells his Chicago Surprise. It is a trick he is known for, and it's a great one. It's basically a combination of Chicago Opener and I've Got A Surprise For You with his own script and philosophy. No new methods. Okay to market as his own effect? I do the razor blade trick with Froot Loops, a different prop but a familiar method. Is it its own effect? And I do it as one part of a larger "Breakfast Gone Wrong" routine that incorporates various productions, vanishes, half the OLEP trick, and the Froot Loop swallow. Completely original 6-minute routine, but combines about 20 existing methods that have never been combined before. Could I market that routine as my own? I think the answer to all those questions is "yes."

Danaruns - I hope I'm not the bearer of bad news, but Gustavo Raley just put a Froot Loops razor-blade trick on the market. It's called The Loops, released through Richard Laffite Entertainment Group - Vanishing Inc is now advertising it on their home page.

Not sure if its appropriate for children - better than needles and razors I guess, but swallowing the string might be teaching kids the wrong lesson about ingesting non-food items.
