This site has a TRUCKLOAD of info on "public domain " music, including song lists, how to determine/prove that a song is in the public domain, etc... Here are a couple of excerpts: "Music and lyrics written by an American author and published in 1922 or earlier are in the Public Domain in the United States. No one can claim ownership of a song in the public domain, therefore public domain songs may be used by everyone." While a song itself may be in the public domain ..., "virtually all sound recordings are under copyright protection until around the year 2067 You will either have to make your own recording from a public domain source or obtain a license to use an existing recording." In other words, you can record & use John Philip Souza's "The Stars and Stripes Forever", because it's in the public domain, but you can't just use the US Marine Band's 1998 recording of that song, because the actual recording is copyrighted. How do I get a public domain recording if the copyright for the recording is good until 2067? I think I follow the distinction you are making but I'm not sure it would help me if I wanted to use some background music.
