Hey guys,
I am facing a problem with my pro name Jay Styles my domains http://www.jaystyles.com has been registered since 2002. Okay my problem is this I have a musician saying that he has had this name since the same day I registered my site. Now he wants me to stop using the name Jay Styles but I have had this name since child hood.. His email: In response to you email I would like to say that nothing has changed. The fact of the matter is that I own the name Jay Styles (as of Oct 18th 2002) and you are using it without my permission. I have all the documentation to prove ownership of this name and I am sure you do not have these same documents. So therefore I demand that you cease the use of the name Jay Styles in a reasonable amount of time or legal action will be taken. Thank you for you time and I expect a response immediately regarding this matter. So now this guys just starts using this name and asks me to stop using it or hell sue me? Im the original Jay Styles... Guys what can I do? I never registered or did anything with this name such as registering it or anything is there anything I can do? Please help.... |

Since it is your legal name I don't believe there is anything he can do. I would not worry about it. Ignore him and he will go away.

It's not your birth name but rather your pro name. Correct?
Look for legal advice. Maybe get some written documentation that shows you've been using the name as long as you have. Good luck |

If you are the one who registered and now has the site, you HAVE the site. Not him, regardless of what documentation he threatens you witth, I would think.
There are laws to prevent people from registering names that have nothing to do with them. For example, if I knew a company was about to start up, I couldn't register the name. Well, I could. But they can sue to obtain it. HOWEVER, if you can show that the name is applicable to you, (either your own name or a business name you have a history of operating) then there is nothing they can do about it. They can threaten, but legally they can do nothing as I understand it. |

Well, to the best of my knowledge, you cannot "own" a name. You can register it within certain areas (screen actors guild, etc) but you cannot stop others from using a name. Business names are different, those you can register. But names for people, I highly doubt it.
As you are two people working in different fields, you are in no way infringing on him. You own the domain, you have been using the name, it is yours. It wouldn't hurt to ask a lawyer, and there are a few floating around the Café, just to be safe. But I do believe that I am correct on this. |
