Hey Guys,
I thought I'd ask a little thing about music for a show. I understand that copying someone elses act is not accepted, but what about using a music/soundtrack***, in your own effects, acts and situtations? *** Providing that the music has not been custom recorded for them. |

I think that it not a problem at all, as long as you are not doing the same effect to the same music. Technically you are supposed to pay into ASCAP for the rights use an artists music in any live performance that is not on TV. But for the most part you don't really have to worry about that unless you are in a major show in a hotel or lounge type of venue with high visibility. But, if you hear a track that you like and want to use it for a particular effect that you are doing I see no problem with using that music even if another performer already does.

Using the same music as someone else:
I'm sure you'll get sufficient feedback in this thread. Using music which someone else has recorded: Copyright laws protect all recorded music, and the use of copyrighted music is subject to permission from the copyright owners. For the ins-and-outs of copyright law, don’t rely upon hearsay, or on any exceptions or work-arounds you may read about: Check out http://www.cmrra.com, http://www.socan.com, http://www.harryfox.com, http://www.ascap.com, or http://www.bmi.com, or the performing rights organization in your country.

We should all hold ourselves to the highest ethical standards. The point of view that you "don't really have to worry about" paying ASCAP or BMI fees if you're not likely to get caught doesn't really make sense. Many people have put in a lot of hard work and effort to create the music that we use in our shows. They deserve to be compensated for it. If you do your research you'll find that the ASCAP and BMI fees are very reasonable. In my opinion they are a small price to pay for the music that enhances and compliments my show. It's also a very small price to pay for doing the right thing! |

There can be some serious fines if convicted of using music without permission. You'll notice sometimes in the copyright lines that some say "public performance prohibited". I know of someone who used unlicensed music and was charged with a small $10,000 fine. Can you afford that? Or can you afford $300.00 a year? You make the choice.
