Does anyone know if there is a standard permit for street performers? I've been knocking heads with the city for 3 days trying to find someone with a clue down there, but the closest I could get was some teenager that tried to tell me that the only permits they issue require a health inspection so I don't get sued for giving people food poisoning. I told her I was a magician, not a vendor, and she said <quote> "Oh my God, a magician...what instrument do you play?" So if anyone knows of a standard form or if there is a specific office (i've hit everything related to amusement) it would be greatly appreciated. Jim

Some places just do not require a permit. Ask at the police station.

I used to perform street MUSIC not far from where Danny Hustle operates - I was never hassled, I just went for it... I did later learn I was violating a local ordinance. I was never hassled by the police, but if licensed magicians have claim to an area, I would avoid it

Confirming what Danny said, two nearby towns in my area, one requires a $35 per year permit the other requires no permit at all. The one that has no permit even has lines on the boardwalk for performers to occupy. Good luck.

In addition to the permit also inquire about regulations regarding street perfromance. While some area's do not require a permit the do require a person to worksuch and such yards(or meter's for our euro brethren) apart from one another to prevent over crowding. Alot of places have decibel limits if you are using sound equipment, other places do not allow sound equipment at all.
Regardless Whether or not you have a permit A policeman can tell you to pack it up any time he likes SO.....it NEVER hurts to strike up a friendly conversation with the local police between shows. If the local cops know you, and like you, they are less likely to work against you. Anyone who works in New Orleans can probaly attest to that fact. I once had an incredibly abusive drunk guy once who was ruining my show till one of the officers i knew saw it and "led" him away. Mat |

In Key West, street magicians are being hassled by the police and by the Code enforcement officers, so my advice is not to come here.
In addition, you CANNOT get a permit to do street magic here. |

Don't ask at the Police station. The Police are lying sacks of *****. They will make up all kinds of regulations. Just go do it.
When the police ask for your permit, tell them politely that you went to city hall, and you couldn't find any requirements for permits. They will tell you that you do need a permit. Ask politely if they know where and how you can get it. They will tell you that they don't know. Tell them that since street performing is constitutionally protected, and has been declared so by the supreme court, you are not breaking any laws. They will ask if you have any warrants out, they will ask for your ID, they will check it out. They will take a long time at this. Finally they will leave you alone. The key is, Polite but FIRM. |

I have the same problem here in Tampa. I am told I need a business license in order to perform, but no one seems to know which catagory I belong in. We settled for the MISC. catagory. It was the cheapest the county could find.

If you are not selling anything, you do not need a business licence in the United States of America. Street Performing is not commerce, it is speech. It is protected by the first amendment.

Interesting question...being Scottish, not aufait with American legislation...What if permits are required and you deliberately don't get one, citing the first amendement, also working in an area where other performers have a permit...
