What are your guys thoughts on having the organization who hires you write up a contract? I personally do not like the idea of it. I would really like to use my contract that I fill out and use for every performance. What would you do in this situation?

I'd write my own contracts, if possible. That way you know you are, hopefully, covered.
If you have to use their contract, make sure you send over your requirements, fees and expectations, FIRST, so they can be included in their contract. Then, read it carefully and don't assume anything. If there is a gray (or fuzzy) part of the document, make sure it gets clarified as soon as possible. Since a contract is a legal, binding document, don't think you can just read between the lines. It's black and white. That's why it's a contract. Mark. |

I have not brought mine up yet
I would like to bring it up but he already emailed me his contract and told me to sign it. After reviewing his contract it looks alright to sign and agree to so far, so I might as well just go with it. I just like the fact of using my own contract because it is easier and there is a termination agreement in it that fits my services. The one in this contract contains a termination agreement, but does not really leave me with anything if they cancel the day before. I would like to atleast have a 15-30 day notice. -john |

Simple....
Reply to him and tell him you'd like to amend the contract he sent to have a 15 to 30 day notice of cancellation. If he is sure he won't cancel on you then he should have no problem with that. If he will not change the contract then you know right off the bat that he will not be willing to accept YOUR contract and you can either take the contract as is or leave it. Best, Tim |

Hmmm...not sure I'd agree with that. If the contract is acceptable in its presented form, why change it? That only makes you possibly look like you're going to be hard or difficult to deal with.
As one who regularly deals with contracts, if I get one that's fine, just sign it and send it back. Then, get on with whatever needs to be done to fulfill ones obligations. Mark. |

I agree with Tim. You'll learn a lot about this client if he doesn't make the changes that you'd perfer. And you have to ask yourself, "Is this a client I really want for the rest of my life?" If this client is so nit-picky and constantly changing things I'd think twice about even doing the show. Refer it to someone else and get a fee for the reference.
I am a big believer in only doing business with people who make ME happy. In fact, just today I was scheduled to have a meeting with a new agent. He was supposed to call me last weekend to meet. I ended up emailing him yesterday. He replied with, "let's meet at Denny's." I told him that I am a serious entertainer with a serious act for serious theatre-goers and I demand a serious venue to plan my career. I was not about to put my career in the hands of someone who doesn't have a proper office to meet in and what seems like no pride in his business. Anyway, rant over. Josh London |
