Hey all. I was wondering, is it legally and ethically ok the sell an effect that's already been published, even if your handling is completely different? I've been performing a certain effect for quite a while (about 3 years), then I found out it was already published. I purchased it though, and my handling is nowhere near his handling.

For the record, it's a Jim Swain effect. Just wondering...

Are you offering a different handling for someone else's routine?

That's like publishing a script for someone else's play with the stage directions altered.

As things stand it's both legal and ethical in magic (let's not get into examples) but it would be much nicer if you sought and obtained Mr Swain's permission before making any such public offerings.

What do you actually mean by different handling? Are you meaning in terms of sleights? Or is the whole routine flow different?

Both. In terms of sleights and style. It does flow differently, and I think more natural as well. I'm in the middle of making a video of it that I'm going to be sending to a few others that know what I'm talking about. Smile

EDIT: It also has a COMPLETELY DIFFERENT kicker ending that I've been doing for years.

Why does everyone in magic for 3 years suddenly think they have to be selling things to other magicians now?

Steve if I had a dime for every thing I reinvented I would be very wealthy. Your at the age where you need to be learning bud, not trying to worry what you can sell to other magicians.

I know you see so much crap out there and it occures to you "Oh heck I can do that". Not really a good approach.

I would have to agree with you (again). But still, I am trying to get in touch with Jim Swain so I can send him my handling of it, and atleast get his opinion on it.

I searched for his website, but can't seem to find out.
