I have a cigar manipulation act with wooden cigars that I make myself. I also made some laminated white cards with labels on them for a routine I have. Someone asked if I could make him a set and wondered what laws there are for making color copies of Cuban cigar labels and selling them?
I have hundreds of labels I have saved over the years and use these on my cigars. They are not anything like John Rogers work of art. I saw these on his site and they look awesome. Mine are meant to look close to real but its obvious it is not. I do not plan on coming close to what he does. I do have a Hemmingway Short Story that IS very realistic. In a wrapper, my close bud's can't tell the difference. So, this is a small hobby for me and was wondering what legal stuff I would encounter selling with labels on them...Cuban or anything? -Scott M |

This is a question to ask in the "Right or Wrong" area. However, I would say you should not copy and sell anything that you did not create.

I'd say if you're making your own "Cubans" and want to give one to a friend, go for it! I think it's illegal to have real Cuban cigars, but you don't. It's made of wood with a label you printed yourself to look like one.

John Rogers did not invent wooden cigars. In fact, he did not invent wooden cigars that look realistic. Since you are not trying to duplicate his cigars, I don't see any ethical conflict here at all.
Regarding the Cuban cigar labels -- it is not illegal to own them in the US. It is illegal to own the cigars, though. At this time, we do not recognize Cuban copyrights, so you can duplicate those labels to your heart's content. Be careful, though. Some of the companies in Cuba have branches in the US, which own the trademarks on the labels.

One can be legal yet unethical.
If you sell something that is not yours it is unethical. If there is a concern that someone might own the trademark, selling it is unethical.
