If you developed an effect on your own based on simple common principles and then found out someone else had marketed said effect with the same method? Bear in mind that in this scenario, you have never heard of the other magician's effect at the time of developing it.

I'd shrug my shoulders, sigh, and get on with my life. This type of re-invention happens all of the time. If the effect is good, I also could choose to be happy that I thought of this good idea all by myself, without the help of the other magician.
What's more important is what I would NOT do. I wouldn't claim the effect as my own, I wouldn't put the effect in print as mine, and I wouldn't market a copy-cat effect. Heck, if the other magician performs the effect as one of his signature pieces, I wouldn't even perform the effect for paying audiences.

I have no intention of publishing it. The effect mine is related to is Joshua Jay's "I dream of mentalism" I don't know if that is a "signature piece".
I don't plan on performing it for a paying audience as I am a casual performer at best. More of a hobbyist than a professional. My late uncle was actually the inspiration for my creation. He used to get me with something similar with a stacked deck. I just made a few tweaks to what he did. |

I would get back to work at it technically to make it even more magical and I would work at a killer script that I would polish performance after performance until it becomes a masterpiece.
