Oracle announced tonight that it had filed suit against Google over the use of Java in their Android mobile phone operating system.

"In developing Android, Google knowingly, directly and repeatedly infringed Oracle's Java-related intellectual property. This lawsuit seeks appropriate remedies for their infringement," said Oracle spokesperson Karen Tillman. CNet provides the full legal document surrounding the complaint. According to the document, Oracle claims: Quote:
Android (including without limitation the Dalvik VM and the Android software development kit) and devices that operate Android infringe one or more claims of each of United States Patents Nos. 6,125,447; 6,192,476; 5,966,702; 7,426,720; RE38,104; 6,910,205; and 6,061,520. The complaint also claims that Google has infringed on several Oracle copyrights surrounding Java's code, specifications and other materials. |

The lawsuit is just beginning, so it's tough to say.
The main reason that this is big news is that Google's version of Java developed for Android is the language used for their apps. Java is a language developed by Sun Microsystems with the idea that it runs on what is called a "Virtual Machine" - the idea being that you only have to write a version of this virtual machine for any platform that comes out, and then you can run exactly the same Java program on any system. This (and the pre-existing programmer base) is probably a large part of the reason Google found it so attractive as a development platform for Android. When Sun owned Java, they treated it as a free, open-source gift to programmers, and were quite open with helping developers. However, since Oracle bought Sun, Oracle has been more pro-active in protecting its intellectual property, including Java. Google had to modify Java with special commands that let it work with the Android OS. According to the lawsuit, it looks like Google just went ahead and did this, without consulting Oracle. I doubt Oracle wants to stop them from using it. However, I'm sure Google doesn't relish the idea of having to pay Oracle based on the number of Android units sold, either. In the short term, this may hamstring Android app development for a while. In the long term, we'll have to wait and see. |
