Hello, I just bought a tape player for the Vanishing Bandana - its one of those older ones that's flat and not too heavy. It can also record things - so I was thinking - I want to record directions with my voice, a funny routine sort of like how the vanishing bandanna works. Or maybe record directions for the mis-made flag? Any ideas?
I was also thinking of doing 5 minutes of magic to music. Does anyone do this, do some silent magic to music? Does it go over well? What type of things do you do? Thanks, Josh

Well first off you would not want to have two routines in your show that are too similar in feel and presentation.
If your doing banana bandana as a direction based routine, then use that one and change your other routines to be different in appearance. This will add diversity and interest to your show. A musical magic routine is always a good thing to have in any show. It really depends though on what your target audience is in terms of how you go about it. If your performing for family or birthday crowd, a nice 3 min musical warm-up works great to get everyone excited about your show and get you and the audience warmed up for the fun that will come next.

Kyle is right about having two tricks with a voice over instruction format. Keep one for repeat bookings.
Performing to music adds a lot to the quality & emotional component of your show. If you want to see this done really well get Ken Scott's Birthday Dough video. I have the Pink Panther theme music play while I twist up a balloon Pink Panther. The Misers Dream & a routine with D’lites work well to music. It is also good to have the Happy Birthday song on your tape so you can lead a sing along if you want.

What about rights to this music? Does anyone know anything about royalities? I've ask this question before and gotten zero response, which tells me that maybe no one actually has the right to use the music they use. Maybe we can do like we did with the tax thing and you can tell about your friends that use music. Or PM me please.

I re-wrote the script for the Vanishing Bandanna and added more and longer pauses and more comedy to it. My wife did the voice-over on the computer and now I've got a "customized" V.B.
I've seen conversations and postings on music rights before. They always start with "I'm not a lawyer and this is not legal advice..." and so your best bet is to get legal advice from a lawyer. My best understanding is that if it is not a public show, then royalties are not needed. After that, it gets a bit murky. If it's a public show, then royalties are due, however sometimes it is the venue or sponsor that must pay. I use royalty-free music. Makes it easy. Mike

Using music is tricky, but basically you can use music for school functions for education. Also you can use music for birthday parties.
The only thing you have to worry about is public shows. If people are paying to come see you perform and the theater or hotel or wherever is not paying the ASCAP fee then you the performer have to pay it. So again, if you are booked for an event that the public cannot come to then you are OK!! This is confirmed. Ken |

HI Scott. I think you will find that your rules above apply as stated but only if you are playing the music in it's original media. I.e. if you put it on to mini disc for a showtec then you are breaking copright laws by copying it. For your rules to apply if you had 3 tracks of music, you would need to carry the 3 CDs that they came on and play them from the original CDs.

I don't think the royalty question is something we really have to worry about. If you use a bit of music in your show it's not really going to have the singer's lawyers knocking your door down. They are more interested in the bigger fish that are knocking out pirate copies. If however, you started selling CD's of the music you use, and were selling loads, then they may look in your direction.
All the mobile disco's would be in deep trouble if the lawyers started chasing the small fish.

Emazdad. The truth is it is not the musicians lawyers that do the chasing. There is an organisation which checks on public places to ensure they have licences if they are playing commercial music. They can, will and do check on performers too. Particularly those who advertise in yellow pages ext. Normally they will warn you to get a license or buy unlicensed music, but if you persist they will take action. Phillip |
