Going back to the insurance companies for a moment...
Insurance companies have legal departments and outside law firms, which exist to protect the insurance companies. Just like any other business. So of course the lawyers are going to do what they get paid for, which is whatever they can do to minimize exposure. It's business. So if it means having the insurance company require a policy of no resistance to avoid potential exposure, then so be it. But insurance companies are funny. When we lived in upstate New York, we had a huge storm once which created a problem with a portion of the roof. Long story short, water inside the house. We had a policy covering this, so we used it. They paid up. However, when we moved to CA and applied for insurance here with the same company, we were denied BECAUSE we had used our policy back in NY. We were able to obtain it anyway because "the situation which caused the claim in NY, i.e., major snow, would not occur in CA." I think the bigger issue isn't whether or not you have a policy of no resistance, but whether every tiny little thing in the world needs to have a policy or a law regulating it. And from what I see every day and read online, it's only getting worse.
