Hi all, I know the topic of using music from other performers has come up before, but I wanted to double deck with you all.
Ive been routining for my losander floating table. I started listening to the music in my itunes and the song GRAVITY by john mayer came up. It fits perfectly with my routine. However, I searched on youtube other performers of the floating table, and I say that justin willman also uses that song. Now heres my question, am I able to use the song ethically? The version I have actually is a acoustic cover of the song by tyler ward and sounds different(the arrangement is completely different)however its the words that work well(those are obviously the same since its a cover). what do you all think? Ive tried contacting him and have sent him a few emails but he hasnt responded. I don't want to break ethics here, so I'm looking forward to your responses. |

I agree with Aaron and would look for another song. Landon Swank also used this song with his floating box illusion on AGT.

In addition to what is mentioned above, please remember that any time you use a song, you MUST pay royalties to use it.
I would suggest looking at some of the royalty-free music available that is written especially for magicians and other entertainers.

Arthur Stead is a grammy award winning musician who writes music for magicians. He can take the gravity song and tweak it so it is not in violation of any copywrite laws but still gives the sound and feel of the original song.

I agree Royalty free music would be the way to go, or chose another song.
However, here's something puzzling. We are saying it would be best if he did not use the same music as another performer (music which is publicly available to anyone who is willing to pay the royalties). However, he can purchase the same magic effect/illusion and perform that. HUH??? (Dealers would rapidly go out of business with that one!) B

In addition, I have used music from MagiTracks. The owner is also here on the Café. I can personally attest for his stuff.

Not a fan of lyrics in the music for magic..
The music should put people in a state where what they are seeing on stage is even more unbelievable.. The lyrics in a song distract too much.. in a bad way. |

Actually Mike, that's often not correct. Technically the VENUE has the obligation. Many that I worked which were legit theatres had blanket licenses and there are many different parameters and ways of doing it. Keith

The ability to use music for LIVE (not re-recorded playback) performance playback can change from country to country - musician / theatrical union to union - as Keith notes, many NA professional venues pay a blanket fee to cover playback of commercial audio (dvds, tapes, cd's, etc) - however that os based on the "original", "non edited" audio track being used - also revenue being generated from the performance of this music can enter into the process - for example in a private, corporate gig, regardless of the audience size, (no attendance tickets being sold for musical performance) I can use any cd that I have legally purchased for playback as long as it is from the cd I purchased and not re-recorded or edited in any way - purchase of legal digital audio directly from internet can be the same but allows for some grey areas to crop up - I am not an expert, but from my past experience re-recording of the music and direct profit of the sale of said music (of course music being legally purchased) really are the key.
