Mr. Brooks suggested that I post this here...
Folks - a question, for those in the know: if I make arrangements with my client to have permission to videotape my performance, am I required to inform the audience (at all?) that the show is being taped, and that their images may be used in materials (promotional, etc.) related to the performance and my website? And, if so, how would you suggest it being done: table-top cards, a big sign, a recorded message at the opening of the performance, some/all of the above? Any advice would be appreciated, since I do not want to get sued later on.. Lee |

There are several answers to this question mostly depending on your intended use of the footage. If it's for profit, a release is required to protect yourself. If it's just for your own personal use, no permission is necessary but you may also want to reference it to cover yourself and to maintain professionalism.
I have videotaped every performance of mine for decades, for personal use (review, critique) but mostly for selling copies after the performance (my hypnosis show). I have signage up at the entrance of the room before the show, in my pre-show announcements, and I also mention and address this in my opening talk, stating that we are recording the performance, it will for sale after the show, and anyone choosing to volunteer or be part of the show is consenting to be videotaped. This way I am using three methods with my intentions clearly stated. The client's know I'll be taping when they hire me. Many hire me specifically for this option. If they for some reason do not want me to videotape the show, they are charged a higher price for the show since they are imparing my earning ability. This also usually keeps everyone on my side with the issue and they welcome the recording. Just my thoughts as it pertains to me. |

Are the performers on stage in a hypnosis show? IF not, I would not worry about it. You are the one performing (magic, mentalism etc) so anyone who comes up to assist you I would consider a non-issue. Especially when they know the cameras are rolling. Comp

Comp - no, not hypnosis, just straight interactive mentalism. My goal is not to use the footage for sales purposes, but as promotional material for new clients.

Mindpro - you say that "...anyone choosing to volunteer or be part of the show is consenting to be videotaped." How would that change the requirement(s) if I am walking through the audience, and I select a person randomly to assist in, say, a book test? They're not really volunteering...

Its a sensitive subject in this day of litigation Lee. I remember when David Blaine got his first break and went touring in a van with a few camera people. The footage ended up on national TV eventually. He wrote in his book they had to get waivers from each and every person he performed for and alluded to how much of a hassle it was.
