If you can't compete on price, you compete on quality or service. You can't compete on anything if you don't have the real estate.

You can't compete on anything if you don't have the real estate. You can start out small and work out of your house, depending on what kind of business you are looking to do (or if you don't own a house, get your land lord's permission so that you can get a business license if the city and county districting law will allow you to operate your business out of the dwelling you are renting). You also need to be sure you have a business license approved by your city or county government or both depending on the laws where you live. It's not how much money you have, but how well you use the resources you do have. And, it's important to take action instead of always finding reasons not to take action. It's all you. Where there is a will there is a way, no matter how poor you might be. Of course, you want to make sure you follow the law and consult an attorney too as soon as you can afford to do so. My starting capital was a tank full of gas in my car and money for a business license (60 bucks) once city council approved the license (which I appeared before them to ask that they grant the license). After that, I got to work cold calling to land restaurant gigs and bringing in more revenue until I was finally able to afford to consult an attorney. Takes money to make money and it also requires taking action too. The market doesn't reward people who make excuses and never take action.

Mom and pop rent corner diner. Starbucks offers twice the rent. Real estate values then go up, driving other local merchants out. This is what is happening all around the country. Yes, mom and dad can go back to selling coffee from thermos bottles on the subway platform.

Yes, mom and dad can go back to selling coffee from thermos bottles on the subway platform. I am sure you don't necessarily have to rent a corner diner just to turn a decent profit. You can certainly save some cash and perhaps set up a few stands rather than pay rent for commercial property or eventually purchase a truck of some kind when you have the cash, or better yet, own the property instead of having to rent it if you can afford to do so. I know I have seen stands set up in many cities. Perhaps this is something a small business owner can do who wants to sell coffee is to set up a stand. Or sell roadside like many farmers do. There are ways around everything and there is a way around Starbucks trying to run the local coffee shop owners out of business while still staying in the business of selling coffee yourself. You can just say, "Well, Starbucks offers better rent than Mom and Pop coffee shops so let's just roll over, quit and die." That's no way to be! You got to be willing to adapt to new conditions in the market and overcome and understand, that their is always a way around everything. Even Starbucks. You just can't surrender and quit.

I remember many years ago, NBC television tried to develop a new logo. What they came up with, after many months of expensive consultations with graphics people was a red and blue stylized "N" symbol;
http://www.etiziano.com/I_love_logo_desi......ogo.html several months later, Nebraska Public Television sued NBC because they'd come up with the same logo (in one solid color) years earlier! NBC settled out of court for a small amount of cash and some used equipment.

My comments about the mom and pop diners were a somewhat humorous (though accurate) reply to Lobo's comment that people are lined up to get into Starbucks. I was just reminding him that the mom and pop diners have been largely forced out--or at least severely dwindling in number. I am not advocating that anyone should give up or switch to something else. I was commenting on the mall-ification of America with standardized corporate food emporiums, a trend that anyone can see with their own eyes over the last quarter century. To get anecdotal about it, twenty years ago in my neighborhood there were at least 4 places to get breakfast. Now we have 3 Dunkin' Donuts and a Starbucks and no diners for breakfast.

I think that's what is so egregious about the OP and why people have instant sympathy--it's not just the David vs. Goliath aspect, but the ridiculousness of the charge that anyone would be mistaking one product for the other as well as the concept of trademarking a word for exclusivity in all realms. As I'm sure you know, that concept doesn't exist for the titles of books or movies--I can write and film Gone With the Wind tomorrow, my epic struggle with flatulence, and no one can sue.
