Anybody here use release forms when you photograph your act? How about crowd shots at parties? I downloaded a PDF release form, but as I was looking at it, I thought I might be opening a can of worms.
Any thoughts? Steven

I always ask up front with the client first but have never had a problem with it. As long as I ask and it is in my contract, it covers me and has not been an issue.

I assume you are going to use photos of the act, including the audience, to promote your act. In that case, if people in your photos are identifiable, the safest course is to get a model release from each person who is identifiable. Getting a release from the customer who hired you is not effective as to any other person (except for his or her children if the release clearly expresses the concept that the parent is giving the release on behalf of a minor child).
If you are not publishing the photos but are showing them to individual prospects, there is little risk of litigation. Properly speaking, however, you should obtain a release before using someone's image to promote your business. --Rick |

Ahhh....I knew somebody from California, the most litigious society in the history of mankind would come through! This is exactly what I thought...so in the spirit of a fun family get together, I walk around and get 30 or 40 releases signed by all of the adults so I don't get sued. Makes for a fun afternoon, don't you think?
I don't necessarily disagree with your thoughts, Ricky, and here in California, that may be what we have to do. As I think this through though, I'm just not willing to play that game. I'm trying to come up with an alternative. There is so much filming going around here in southern Cal, I've signed a release or two for a crowd shot. The big boys do things like that, but there must be a better way for the smaller operations. Thanks for your input, it's something I am considering. Steven

A company I worked for took pictures (I'm assuming they didn't have permission). When they published the photos on the web site they obscured the faces of the crowd. I assume this gets them out of the "identifiable" portion of the model release. What about this; you are doing something and someone takes a picture of you and the small crowd. At the end you say, "Everyone write your name down here so I can put your name with your face for the photos!" Make it sound like fun. Then have them sign a blanket release. Maybe make part of the incentive, write your email and I'll email you a copy of the photo. I think this really implies a release. Edd Not a lawyer but sometimes a shrewd guy.

That is not a bad idea and could work well. I often have done the blur filter technique with my design work I do for the company I work for. If there is big crowd, We simply bring the image into Photoshop and blur out the people a bit so they are out of focus. It still looks good but it gets you around the release form situation. What I do is 1) state it in my contract that I do film the shows and take pictures and use it for my own marketing materials. and 2) I personally ask permission at the venues before I get there. This has worked well for me and it really has not been an issue for me in my own local area. Kyle
