The bigger question, I think, is can you use it in your show without paying royalties. Plenty of discussion here on the Café... as for your first question regarding ripping, why when you can get the CD quality by buying the CD for as low as $2.70. And by the way, it is the original, I own a copy.

I want the exact song from the introduction of the show, not the longer version that I think was a top 40 hit. Also I want it in a format that I can put on my iPhone and connect to an amplifier. Will what you linked to do this?

What I would like isn't important. Doing the proper thing is important. That is why I am asking what the proper thing to do is. Suppose the proper thing is to to pay for the rights to use the song. Then who do I pay?
Furthermore, if YouTube can use videos like this in their business supposedly without paying for it, why can't I? It is not so clear cut to me. What is the law? |

Often the proper thing and the law differ. As an artist I would think it paramount to compensate other artists for their work regardless of the law. This is why I ask. It has nothing at all to do with You Tube.
That is an opinion and nothing more.

Best to contact the appropriate agency in your country for more information. As one who has had to deal with rights and clearances, I can tell you this can be like jumping through hoops. I contacted ABC through email. I want to also perform magic with the music "Hooked on Classics", so I contacted K-tel records, who apparently has the rights to this song. I hope this will be simple and inexpensive.

Hi,
I've tried contacting publishers directly in the past and have found they want to charge a fortune. It's just that their team is used to doing big deals, so they work with big numbers. Music clearance gets really complicated but I think you might only need direct publisher approval if you need the "Grand Rights" - i.e. if the music is being used to tell a story. For other uses of music you might be better off getting the clearance you need from a performing rights society, as jstreiff says. Not sure about the US, but in the UK, PRS have theatre licenses that are affordable. Best to tell them the exact context in which you're using the music. I think there's a fine line between whether music is 'background' or 'part of the story' in magic, but I think as long as you've explained the context to whoever is granting the licence, you should be covered. Hope it works out! |

Also consider that there are a LOT of royalty free works in all genres- many of them excellent- available at very nominal fees. Just do a search on "Royalty free music."

On Saturday I used a piece of music by a recording artist. I contacted them for permission and terms in advance, and we worked out an amicable arrangement.

As a former DJ, I think it would be a good idea to check with BMI and ASCAP...the majority of singers, musicians, and composers register their material with them...however, that hasn't stopped a ton of magicians from using these materials without permission...
