Hi can any one tell me where I stand, if your one is British and want`s to do a Busking tour of the USA.
Can I do this on a Holiday visa or what? Where is the best place for me to head to busk? Kind Regards Mario |

I've heard tell, from someone who I consider an authority, that the best busking in the world is Boston. I have no personal experience of Boston, but just passing along what I've been told. Jim

I've also heard that Boulder, Colorado (someone correct me if this is wrong) is very busker friendly - But I have no personal experience out there. Look it up.

When you enter the US you'll receive a stamp that grants you leave to enter and remain for a given length of time (six months was what my UK entry stamp said), but it will most likely feature the words "Employment Prohibited". You shouldn't get any serious trouble if you busk, but do keep in mind that asking for money could be construed as employment and jeopardize your status as a visitor.

This is the single biggest drawback to a permit system.
Boulder is good. No permits there. Boston required permits, but that was years ago, so who knows now? |

If you busk in the USA or accept any money for any kind of employment whatever you are liable to be deported and denied admission for another 5 years.
You can do it on the sly certainly but you will be working illegally in the United States. Under no circumstances should you tell an immigration officer at the port of entry that you are there to busk. You will be back on the next plane. One tip is to leave from Shannon Airport in Ireland. US immigration is stationed there for pre immigration clearance. In other words you will be cleared by the US authorities before you get on the plane. You may still be refused admission but at least you won't be held in detention while deportation proceedings are put into operation. I am not trying to frighten you but you should at least know the law. I remember a rather foolish young magician came over to the United States to do a lecture tour and was denied entry. He did not think to research the matter. Even Harold Taylor was once refused entry when he wanted to do some lectures in the United States. I am amazed that so many lecturers and performers come from overseas to appear at conventions not knowing the rules. It would only take one person with an axe to grind to phone up the immigration authorities and ruin the convention. Sorry to be a prophet of doom but it behooves anyone who wishes to perform in other people's countries to know the rules. The good news is that as a British citizen you can work anywhere in the European community without work authorisation. Americans will still need a work permit though. |

It has always been difficult. Since 9/11 it is virtually impossible.
Strangely enough the best information on US work permits for entertainers is the CANADIAN government.I kid you not. Do a google search for "Canadian performers publication." You will come to a Canadian government website. Somewhere on that website is invaluable information for foreign entertainers wishing to enter the US for work. It is geared to Canadians but a lot of the information would apply to other nationals also. I do not have the URL for the website at hand; otherwise I would post it here. The ironic thing is that the Canadian government has eased restrictions on US (and other) entertainers wishing to enter Canada to work.It has always been relatively easy but now it is virtually an open door policy. However, it is not a reciprocal arrangement. The US still makes it difficult for Canadian entertainers to work without a lot of bureaucratic hassle. This lack of repricocity has stirred quite a lot of resentment among Canadian entertainers and in fact I understand the Musicians Association in Canada has lobbied the Canadian government to be a bit stricter on letting Americans into Canada to perform. |

Nah, try Southern California. My best buddy teaches middle school here. He says that out of his 265 students, about 80% of them entered the U.S. illegally. There's only the illusion of a border here. Visas are merely a suggestion!

We have the same problem near GB. It has gotten worse since 9/11 Tony Blair has just addmitted that GB immigration is out of control (not with those words, mind). So if you want to Busk it over here then this is a good time. I know, let's do an exchange. LOL |
