Oh good grief...did you catch the "severe emotional distress, requiring treatment for depression" phrase at the end of the story?
Well, I think it all sounds like a lovely segment on Oprah: "Buskers, rules, and why the two just can't get along." It boils down to this, IMHO; if you're earning income in/on a public venue, the state has the right to regulate how/where you can do it. Heck, it can even forbid certain types of income-generating activities; e.g., prostitution. However, the state could bend a bit in this case, as well: passing the hat is a time-honored tradition among buskers. And spectators always have the right to say, "no, thanks."
