Joe, I am definetely not an authority and like everyone else, am only stating what I have been told. My contacts work directly for the federal government and they gave me the contacts for individual states saying that each state dictates the rule differently.
Just out of curiosity, if the inspector was out of North Carolina, what prompted her to make the visit to Penn in the first place?

Boy isn't this a great way to spend our tax money. Sending some from North Carolina to Penn. to check on rabbits?
I think once I get some more information on this I may write my congressman or pass it onto Russ Limbaugh or similar talk show host and let them run with it. I can just see all the 12 year old 4-H kids scheduling home visitations to check on their bunnies which are exhibited at county fairs. What a bunch of crap!!!!! Richard

Dave, I did not say the inspector was "out of" the NC office I said she was "affiliated" with the NC office. This woman lives and works for the USDA in Pennsylvania. I mean this woman was not a ghost she was at TOMS house THIS MORNING. Again she told Tom that TWO different offices of the USDA are overseeing this. The one in Raleigh for the east and the one in Fort Collins for the west. The president of the IBM ring in Seattle has gone through he same thing and the Government officers that came to his house "from what he said" had NO sense of humor. So if they do contact any of you guys beware of making any wisecracks. As for your contacts in the government I am sure you know that when it comes to the US government FREQUENTLY one hand doesn't know what the other hand is doing. By the way, they are not just going through the yellow pages LOOKING for magicians, Tom performed at the Allentown Agricultural fair and that is how she caught him. Joe Keppel

Joe, that's exactly what we have all been saying. Bureaucratic Bull or Crap as Richard calls it. Branches of the government whether state, Federal or local never know what each other is doing. That's what's caused this discussion here. No one has the exact answer and the governments aren't providing any help.

Considering it was an agricultural fair (a place a USDA official is going to be) would explain why he got caught. Come on, we all know we have to license our cats and dogs, so is it really unreasonable to have to license other mammals? I'm sure it's just frustrating because most people don't know about this kind of thing and it is probably rarely enforced. I suppose it's the same thing with magicians who choose to use music without paying for and obtaining the rights. Every show you do, you take a chance that you will be caught, fined, and/or prosecuted. Cris Oh... and here are the three biggest lies ever told. 1. Well there is certainly a public health factor too. At a livestock exposition, your animals are going to be around other animals. In a performance, your animals are going to be around people. There is the potential for spreading disease. In my state a law was recently passed that makes owning non-human primates illegal (sugar gliders, for example). Because non-human primates are so genetically similar to us human primates, the capacity for the spread of disease is incredible.
There's also reasons behind hunting and fishing licenses, too.... well, okay, maybe those are more about money. But the state, at least theoretically, has an interest in making sure that populations are not overhunted and that lakes and ponds are properly stocked and not over-fished. Especially if the state is paying to stock public lakes with fish and pay rangers to patrol public forests where hunting is allowed. The same goes with copyrights and performance rights of music and illusions. There is a reason behind it and it is about ownership and not strictly about "just money." If someone makes a knock off of an origami illusion without receiving the rights from Steinmeyer, you are stealing something owned by someone else. Pen and Teller commented that this is no different that going into someones house and stealing their TV because you happen to like their TV so much. I guess here is what I'm wondering concerning Joe and Skip.... You've indicated that it will cost $40.oo total for the rabbit license and that you've been advised not to use your rabbit in any shows (excluding b-day parties) until you receive the license or you will be subject to fines. Is this correct? I guess the main question that pops to mind is how long will the licensing process take? That could be a problem if it's going to take a few months. Cris |

Ok, I can understand the animal check at the fair.
When I showed cattle, we had to run a battery of tests before we could show the animal. But they never came and inspected the farm or barnyard. I'm sorry that I have ranted a bit but this is really stupid. When you figure all the money that is wasted on other things in government, no wonder we are trillions in debt. I just read an editorial today about how many millions have been spent on the beach front property that is privately held to stabilize the beach so the millionaires can have their homes there. So I am not in good mood. There are people who have been devastated by the hurricanes and need help. But if you build a house on a beach should you expect to deal with the elements? Richard

Cris, you are correct that we are supposed to license our dogs and cats, but we are not subject to housing inspections or surprise visits to make sure we give them a good home in order to get the license or maintain it. I think that's more of a concern to us that the actual payment of the fee. I personally wouldn't have a problem if the regulation simply stated that a license was required for a small fee. I believe the requirement is good for breeders, food industry people, pet shops etc but not for the individual that wants to keep a rabbit or a performer who uses one.
I'm all for animal protection and proper treatment but we have many state and local agencies that have the responsibility of enforcing those types of laws. We don't need the federal government inspecting us FOR A FEE. Richard is right, with some many things the fed should be taking care of, like people living on the street or going hungry or devastated in storms , they're concerned with whether or not my rabbit hutch is 6 inches shorter than their regulation and in order to determine that, I must pay a fee to pay for it. Stupid isn't a strong enough word in my opinion.
