.....my oldest son will have been missing for 48 hours. According to the police, they can't do anything until after 6:00 p.m. tonight because it does not state in the divorce decree WHICH weekends my ex-husband has his son. It doesn't matter that early Friday morning, I spoke with him, and he agreed that this would be my weekend with him. It doesn't matter that my son spent six weeks with his father at the beginning of the summer, and I didn't see him ANY during that time. It doesn't matter that his home, which I went by many times, is vacant and boxes are inside, and neighbors say he doesn't live there any longer. It doesn't matter that no one on his side of the family is answering my phone calls. I don't know where my son is...and it's driving me crazy! I understand the laws are there for a reason, but this isn't right!

I agree Margarette. I hope that someday the law will change in your favor. I also hope that you hear from your son soon, and that he is safe and sound.

I suggest you contact a lawyer and begin proceedings to have his rights revoked or at the least require supervised visits. I would also suggest looking into a private investigator if the police will not do anything. You can also put several search engines to use that are useful toward locating people with minimal information (such as name and age only). I hope this is of some help and I will be thinking of you and your family.

Fortunately, my son was returned to me. My ex almost didn't want to return him until he was informed that if Benjamin wasn't back by a certain time on Sunday, the police would be called. Today, I spoke with a co-worker who is a former law enforcement officer. I told him of my predicament, and he gave me advice on the best route to go. I've got an appointment with an attorney to get the ball rolling with this matter.

My ex filed a petition for a change of custody because I moved to Memphis. Up until now, the moved hasn't caused a problem in visitation or anything. My lawyer will counter-file a petition for all the back child support that is owed and for an increase. She said that I really don't have anything to worry about since my apartment is not a "den of iniquity." She gave me a few cases to read, and they invovled joint custody cases, and the courts were reluctant to remove the child from the parent who has physical custody. I have full custody, my ex only has visitation, and the move cannot be considered a "material change of circumstances" since the distance from Little Rock to Memphis is not that great. So, now, I have to get my son registered in school, and take more leave from work to hassle with the legal mess. I think I'll ask my lawyer to put something in the filing about reimbursement for lost wages/time off work. May not work, but at least there would be a record of it!

As the information I sent you privately before should indicate, I am a registered lobbyist for the rights of children of divorce. There is a wealth of information available to you. Just hang in there like a rusty fishhook. Time tends to solve these problems.

I raised my two kids alone. It was worth every minute of it. Sometimes the system doesn't know the difference between help and interference. Go for being a full time parent. The other stuff will get handled.

I too have endured the legal system. After ten years, 3 judges, 2 magistrates and two counties. I got custody of my son.

I had a similar instance when my ex wife took my son out of state and did not return him on time. I was going crazy but finally got a prosecutor to go after her for a felony charge ( it is). By the time it got to trial (she would never show up), it was all brushed aside. The courts do not care and will not enforce the difficult cases.

I am sorry ( I know I will get flack for this) but I have absolutely no faith in the legal system. I never received in over 10 years any child support. The courts never made her do anything that was written out. It was joke. If I were to do it over again, I would have done things much different. I would have done what I felt was right and then complied when she did. But since she was out of state it was a mess.

Thankfully, my son is now 18 and at 16 I sent him to live with his mother who has taught him how to run the system.

Hang in there. Stay the high road as best you can for the sake of your son. Be there done that.
