What was he thinking?!
If he has the itch, he should scratch it somewhere other than on the bench. I'd say he's unfocused... and replace him.

My take on this is different -- As long as the legal reasoning is sound, I don't see anything wrong with presenting it in an interesting fashion, or having fun. That's why I love to read Scalia opinions even when I disagree with him; out of the nine people on the bench, only Scalia writes as if he has a job he can't be fired from.

You have to realise this is another culture...
In past other judges have delivered their judgements in iambic pentameter(sp I know), some in Haiku, etc. There is much precedent for things like this in the british courts, I don't think he was unfocused at all, it just shows they can have a sense of humor too! I think this was great! |
