I had devised, proto-typed and have just begin production on a chair communication system very similar to the "SUPER-CHAIR" which was just released this week.
We call our system "CHAIR-COMM 1". The entire point to this system was to have a secret communication system with a VOLUNTEER with absolutely no verbal cues or any sign of communication. I created an extra bit which let's the volunteer in on the workings that you would absolutely LOVE. If you think about this, it is an INCREDIBLY POWERFUL TOOL for mentalists! We do NOT have the "SHOCKING" feature as it is not relevant to the overall power of effect that this system can give. I have consulted with several reputable builders over the past 6 months and can assure you we have been at this project for some time now. I was so darn proud of this concept and was just as excited to release it as the mentalist who were "In the Know" of my creation! My chair and package differs in the following ways: The CHAIR-COMM 1 is a Powder-Coated Standard Style Steel Chair The Communication system is not based on VIBRATION as we found that that created a jump/jiggle from the ladies when tested. Our system cue is subtle but very detectable. Extra gimmick which cues spectator as to what will be happening. Extremely detailed and developed routines by a performing magician. We were just ready to filed test and video tape various performances which would be included on DVD. Comes with a Heavy Duty ATA Case So...I am in an ethics jam. I have a TON of time and money wrapped up into this system. I am willing to listen to all opinions and make my call from there. Thank you Chance Wolf Wolf's Magic

Hey Chance, In MY opinion you have Nothing to worry about!
Obviously you didn't just RIP-OFF someone's trick, as you said you have been developing this for quite some time! It's not like you took a chair and whipped this puppy out! Besides from your description it sounds like it is different in MANY ways! Your reputation preceeds you and everyone knows you are a Stand-Up Guy and would NEVER compromise your ethics! I say go ahead as planned! Now get to work, quit messing around with chairs and release that "WACKY WIZ-KOTE MACHINE", will ya!!! =Frank=

It would seem to me that your reputation would see you through any doubts. Still, your chair sounds sufficiently different from the other. It's a case of mutual lines of thought. It happens. Market the chair.

Chance, I think you should be able to release yours. It is obviously a different concept for different reasons. I don't know if the methods are similar, but the concept of a communication device for mentalists is a separate idea. I first saw the ad yesterday in MAGIC Magazine. Yes, it is called the Triple Action Super Chair, but the ad reads as an electrical chair. The vibrating system is a third option, but it is being billed as an electric chair. I don't know much about using an electric chair. I have seen Kozak do his routine and Paul Daniels do his and I think they are both great. Personally, I don't want the chances. After reading and hearing about the 45 thousand warnings attached to Electric Touch, I am not that big on it either. By devising a communication system that does not provide an electrical current to your volunteer, I think would allow you to release yours independently. But, again, just my two cents. Let's face it, Alpha Magic is not the first to release an electric chair, nor are they the first to release a communcating system for mentalists. They were able to combine them into one (and come up with the added benefit of the naughty chair for a kids time out). But your releasing a "communication chair" alone is no different then releasing an "electric chair" alone, which have been around for years. Just the other day, I saw an electric chair in a Stevens Catalog from 1991. I say, as long as your chair is not an all-in-one chair, or a 3 in 1 chair, then it is entirely different. The fact that you were willing to ask about the dilemma alone shows you have more class than quite a number of magic producers. Not an easy spot to be in though for sure. Now......get to work on a Legs Table. |

Chance, Chance, Chance, what were you thinking? How could you possibly release a chair like this without adding the special feature "Weak electrical current for children's shows"? The makers of the Triple Action Super Chair didn't overlook this most important of features. I would think a seasoned children's entertainer like you would realize the power (pun intended) of torturing small children for the amusement of others. But no, your chair simply wiggles or something to send a super secret signal to a volunteer. By your own admission it doesn't even vibrate so you can't take advantage of a Magic Fingers massage to ease the lower back pain brought on by a grueling performance of electrocuting small children.
Go ahead and release your inferior product. There's no conflict or competition that I can see. after all unlike the far superior Triple Action Super Chair your chair only does one thing. And what are super subtle, mind blowing, well thought out and routined mental masterpieces performed with an exquisitely designed and manufactured prop when compared to all the fun that can be had by running electrical current through innocent children?

Have you seen the juggler that has a Swiss Army Cat? One of the funniest bits I've seen in a long time. Sharp claws that extend, teeth and a shark like fin.

The concept of a chair that electronically communicates information to an audience participant, both through sound or through vibrations, is not new. It's been around for a number of years, in fact. I'm sure that the research you've done before deciding to market this prop showed the previous incarnations.
If it were me, I'd give credit to the original inventors, see if any of them are still marketing their chairs, and if not, then go ahead and put mine out for sale. - entity

Actually, I have researched extensively including talking to dealers that have been in the business for 30 years and I have never seen a system like mine, in principle or even basic effect. I'm not sure exactly what your chair is offering. I'm only aware of it through these posts. I wasn't trying to slag you off, I'd assumed you were aware of the previous versions. These were kept quite secret, and offered on a very limited basis to insiders in the Mentalism community, which is probably why the Magic Dealers had not heard of them. - entity

It's like the discussion that we all had in your workshop about copyrights to tricks and props. Remember that today's industrial shop tape dispenser originally came from a small 3M creation......how many differences do there need to be before it becomes a different train of thought? As said several times previously under this topic, your reputation precedes you. You have many well known faces standing behind you and friends ready to stand up for you. Go For It!

I was battling how to market this effect as it has so much potential but I did not want to give away the basic workings...heck, I didn't want to say much at all. I was actually considering keeping it underground myself. Unfortunately, the public release of the "Super-Chair" by the other company forced me to tip my hand as well as exposed the concept in it's own ad. I appreciate your help and input and in no way did I fell you were slagging me off. Astrid, You make great points and it was nice to have a gal in the biz stop by the shop and talk good magic. Very telling on how we ended up in the state of affairs we are in. If the coincidences were reversed I bet most of the people posting here would be crying "foul!"

Actually, I asked myself that exact question. And to tell you the absolute truth,"If the coincidences were reversed", I would not have barked one tiny bit and I would have asked my supporters or anyone else to back off. The magic manufacturing business, like any other, is open for this situation to happen at any given time. I am surprised it does not happen more often. It is an easy decision to give the other manufacture the benefit of the doubt due to the extensive R&D time involved on any project. There is no way a company can develop a quality product in the brief time as in my situation. The upside is that even with two competing ideas that there will be a choice. One may have subtle differences, one could be of lesser quality etc. Who knows, I am not a fool proof creator and maybe mine would end up sitting on the shelves collecting dust! I will make a public statement that if I end up on the other side of the coin then I can assure you that not only will I protest the release but I will discourage anyone from crying foul play as well.
