Indeed... your only real chance of performing this on the street would be as a performance, where you didn't take bets from members of the public. On the wording of the legislation in England and Wales, if you had stooges in the audience who placed the bets, which caused the tension and interest, then, that should be permissible, as the stooge is not "playing a game of chance for a prize" but, my gut feeling is that you are going to either get moved on or arrested anyway - the legal intricacies of a situation are not always discussed before action is taken...

If however, you spoke to your local council, or whoever licenses the area in question, and discussed with them what you were going to do, they might well issue you with a licence which has the necessary wording printed on it (eg. "performance of magic, including a performance of the three card monte") - I'd stress the need to get the three card monte in the wording of the licence, depending on how your area does it (I believe Southampton CC, for example, used to print pretty much what we asked), so that you can show it to any interested policeman on the day. I was suprised just how helpful Southampton CC was in encouraging street performers, so we used to perform at various pitches around the city quite regularly.

Now I must say; Don’t be a FOOL, you don’t have a chance, in you know where of wining anything. These are not games of chance!!!!!!

This is a great definition of a game of chance.

However as there is NO CHANCE of you winning at three card monte even if you know where the lady is at all times!
