Hey guys, I just wanted to ask the advice of my fellow Café members regarding an issue I've encountered.
I paid for a new Deep Astonishment 2 (no need to use names here) and it came unusable. The button on the wallet was bent and as a result, destroyed one of the "Quotation" cards. I mentioned this to the seller I bought it from and he was very nice and had Murphy's send me a replacement directly. Now he naturally wants the bad item back to return to Murphy's for the credit. I of course expected he would want the bad item back and I certainly have no use for it myself and feel he should get the bad item to send back for credit. Here's my issue: He expects me to pay for the postage to return the item to him with more money out of my pocket. I told him I thought it should be his responsibility to provide me with postage and that I didn't think it right for me to have to pay more money to return the faulty item he sold me. The reseller is very upset at me and went on to say that it was a shame I had "no human consideration." Am I out of line here or should the seller pay for postage to return the faulty item? I work in the computer industry and on many occasions I've had to have bad PC hardware replaced. The new item always included return postage. Can you imagine Dell sending you a PC that didn't work and then charging you for the postage to return it? Me either. Anyway, I told him I would post this (without naming any names) and if everyone felt the same as he did, I would open my wallet "again" to pay more money so he could get his item back for credit. |

The seller should pay the postage . That is good business practice.

You should not have to pay the shipping charges to return defective product. Depending on the service that the original order was shipped, the seller should issue a call tag or send you a prepaid postage label for the inconvenience.

The seller should pay the postage. If the seller had insurance it should be covered.

The seller should back his/her products and services 100%. He/She should pay the postage. |

You should not have to pay and the seller should go after the post office for the cost of postage and damage to the item.

I believe that if you are going to be a "dealer", no matter how small, paying for the return of defective products should be part of your cost of doing business.
However, ixnay66 it sounds like you are willing to work with him.... From what I have hear, it sounds like the seller is going to have to incur postage costs himself to ship it back to Murphy's once he gets it from you. So, what I propose is that you actually send the defective item back to Murphy's on his behalf. He may need to send you a letter/note etc to include with the package explaining the defect and perhaps include his account number or something (I have no clue). You address it to Murphy's and put HIS return address on the package. So, as far as Murphy's is concerned it came from him and they can process his refund. In this way you can ask him to pay for the postage. You seem like you would be willing to mail it back anyway...so you do him the favour of mailing it, which you seem prepared to do, and he does you the favour of paying for it...which he was going to have to do anyway. So that way no one pays for an extra shipping cost. Just a thought... Mitch

Thanks for your reply Mitch. That's actually what I wanted to do. I only wanted him to paypal me the cost of postage. He then replied "Keep it. I've lost enough money. My karma is clean." and told me to throw my "last hissy."
I still don't want him to take a total loss but he's taking the high road apparently and according to his email "The universe will even the score." Not the most business-like attitude but I'm hoping he'll read these posts and shoot me the postage so I can send off his merchandise so he can get a credit. |

If I were you I'd pay the postage. He was kind enough to contact Murphy's and get you a brand new item! Karma will be in your favor.

True...but he advertised a new item in perfect condition. So shouldn't he have contacted Murphy's for a replacement anyway?

The seller should pay postage on defective returns.
And I don,t know if this is an issue or not but... It seems the First Class Postage for that wallet and a card would be about $1.50 including delivery conformation. |

Given that the seller likely had no stated "defective product" or "return" policy there is no real "right" or "wrong".
He fixed your situation with respect to a faulty product...now he wants you to pay to ship the old one back. It really is up to you. You can just send it back to him and pay for the shipping be done with it. Or, just hang on to it and let him know you would be happy to send it back to him if/when he sends you postage. Don't be mean about it in either case (I know you wouldn't anyway). What we say doesn't really give you an answer...just our opinions. If he had a stated returns policy or told you clearly that he stands by his sales 100% for quality or something to that effect then it would be a different story...but he did not. So...we can tell you whatever we like but ultimately you just need to decide what you want to do. Mitch

I've always believe seller should pay the postage in situations like these. But it is not uncommon as you'll find on ebay, sellers stating in their return/refund policy that they will refund your money less shipping, no refund on shipping charges under any circumstances, buyer will incur cost of shipping back item, etc.
It is then up to you to do business with them or not, up to you whether or not you want to enter such an agreement. If no agreement was written beforehand, there is no right or wrong here. You guys just have to be gentlemens and work it out. |

I haved purchased DVD's from 3 well known dealers who sometimes post on this forum and have had to return defective DVD's. They replaced the DVD but I had to send the defective item back at MY EXPENSE. They did not charge me for shipping the replacement. I thought to myself that they should compensate me but never said anything.

Part of building a reationship with a dealer is a bit of give and take.
I recently had a bad "The Cardician" DVD which my dealer agreed instantly to exchange. I put up the postage to send the bum disc back to him, and he put up the second postage tab to send a good DVD back to me. I guess karma can work both ways. Having said that, I don't think you're doing anything wrong at all by asking him to pay the postage. For me though, it's just not worth the stress and grief, and I want this guy on my side when expensive stuff goes wonky and it's not so cut a dried as it's "his fault" or it's "my fault". |
