Rob, I'm amazed. You had a go at a guy called Ben Lewis a couple of months ago....and it appears he has just found my site and copied mine word for word!
my site - http://www.fletcher-magic.com/corporate.html ben lewis - http://www.livecorporatemagic.com/corporate.html I was performing magic long beofre I had a website, so when the time finally came for me to go "online" I did a lot of research into what content other magicians had. It is hard to distinguish where people are copying when we are selling the same sort of product...but when it is word for word, it is a bit more obvious! Like I said, I will hold my hands up and say I have looked at other magicians websites for information Ben can inspect some emails/phone calls later on this week..... |

**Like I said, I will hold my hands up and say I have looked at other magicians websites for information , but not copied word for word I'm sure of that. I guess people look at different sites and realise we all sound the same, but when its word for word surley that's wrong?

Yes, Ben is a previous offender. He lifted my website wholesale and when I rang him up he hung up on me as soon as I said my name. He removed my stolen content after a few days.
I suppose I should cut him a bit of slack as he is a child and perhaps didn't really know any better at the time but it would seem he hasn't learnt anything and is still up to his old tricks... |

The performer who lifted from me, has lifted phrases, complete paragraphs, complete testimonials, complete headlines, etc.
There is no doubt that he did not create this content himself, independently. The copyright notice on my website is very clear. - Donald

WOW, this is amazing! I now must ask about copyright protection. This is straight from a lawyers perspective. If your website is listed as Copyrighted and you have no PROOF to back that up then your content is FREE to use. It is not ethical but it can be used. And I doubt that many who have websites have paid the FEE to have your content copyrighted. That said, keep blowing smoke you are WRONG. I personally would not use another persons material, but please lets be honest for once. Magicians are some of the biggest story tellers on the planet. So many say that their material is copyrighted and it is not. I know of very few magicians who can afford to pay for copyright fees. It is quite expensive and the average performer cannot afford the fee. So quit blowing smoke and just go with the flow. If someone does use your content then I would take that as a compliment as my site is better than theirs.

Is there a law about using the copyright logo when something is not actually copyrighted?

There still is copyright control. Also other methods without paying for a copyright. Also, you don't need to have paid for copyright to be protected by it's laws. You just have to have proof that you did it first which is not hard to do.

Written material is copyrighted by operation of law at the time of creation. Are you talking about REGISTERING copyright? The fee is $45. ( http://www.copyright.gov/register/literary.html ) Who is blowing smoke here, exactly? I think you need a new lawyer. I'm not available, unfortunately. |

Wow Flec! That's obvious straight copying. He may have change 4 words by it is the same. I don't think monkeys with typewriters would come up with something that close!

My website only went 'live' last year, but most of the text I had on promotional material for at least the last two years. When it came to writting content from my website, much of it came from my own leaflets/postcards etc.

I've used copyscape.com to look up some of ben's other sites, and he has done the same thing to other people!
He offers a web designing service at This Link and the text looks strangley similar to the website of This Company. Brendan Patricks has also had his website copied by the looks of it, by the same guy!!! Ben Lewis |

Would it be OK if I started using the line
"It pays to be lousy" on my website? (lets see who figures that out)

This exact same thing happened to me earlier this year. Every aspect of my site, from my biography to the description of my show was on someone else's site with their name thrown in!
One letter corrected the problem. |
