I looked at Jim's website...IMO (and I'm no expert) the photo Jim is now using to justify his argument isn't the exact design in dispute.
As I see it, Jim's removal of the cup selection section on his site is a deliberate action to punish the magic community for not supporting 'him' in the dispute between the parties involved. I think this further outlines Jim's self righteous attitude of superiority and show's that in Jim's mind...its all about him. On a different note, I'd like to hear more about this new coins across...Johnathan?

My post above was based, in part, on Jim's comments found on his website three (3) days before his post over at Genii.

Latest update ... 1/18/08 While I'm suspect of the timing of the two events and feel there's a contradiction in what was posted on Jim's site in comparison to Genii's forum - I'll retract my comment below in light of the more recent information you brought to my attention. Quote:

According to Patent, you can not patent a cup, the Patent officer told me when I spoke with him.
The funny part was, Brett tried to Patent a ring around the cup. They told me that the patent office Gets a lot of applications for magic in general and they are turned down. Brett was denied by the Patent office. The trademark only protects his logo iniside the cup. A cup no matter what it is Used for will most likely be turned away. People, including Brett Sherwood said the Foxy II.5 was a copy of his cup, not true. My father took The Foxy 2 and expanded it to hold a tennis ball. It all started with a Foxy 2 cup and expanding it to Hole a tennis ball , while trying to make the cup as small as possible. My father achieved that. The actual Foxy 1 wan't the first Foxy. The first Foxy cup was a combo mini cup. They made 2 types One in aluminum and one in copper. One box says RNT. The other box also from Magic Inc. said Milt Kort Cups. Same design and both sets were combos. Not many know this. My father had told me and I have the pdf between my father and another Café Member. Dad had Had enough and the member reminded him of the Wolf theory. When you get attatcked by another Wolf, its time for the other Wofl to attack back.. He gave it a lot of thought and he proceeded to Attack back where it hurt them. The Brett Sherwood cups were based on Paul Fox cups. He had A lip on his saddle, he claimed that he could patent a ring on a cup. Rings on my father's cups were A whole different beast, he changed shoulder beads. He used the Paul Fox cup as part of the design Just like 100's of others have. Jim won't get far in court if he ever tried to file a motion against me.. I haven't done anything. He would Have to go after RNT II. I don't really think he wants to do that. While my father got worked up over The little stuff with Riser, I'm just going to ignore it. Because my mother no longer has the Incorperation There is nothing for Jim to go after. If he does I hope he has a lot of m money as a retainer fee. I mean no one any harm, I don't need to copy anyone, I've got books upon books from the. 1800's that Have plenty of open domain effects. I wish everyone here in C&B heaven all the very best, even Jim Riser. I hope my products are well received And if not, then I still have my fishing company. I own. All the best to everyone and I promise to refrain from anymore rants. Unless of course they are attacks On my family. Peace and love to everyone and everyone that supported my father and RNT II. Jake Jr. PS. Mr. Buckley, you're doing a great job.! |
