Oh Jerry... This is not good. The magic community is a small one. Everyone knows just about everyone... Did you really think you were going to get away with this?
I take back my previous advice and offer some new advice: Take the site down and apologize profusely to B-Rad! |

You'll reap what you sow, Jerry. John Cesta has nothing to worry about...His stuff is from the heart and potential clients can tell the difference. You, on the other hand, Jerry, should get used to wearing a paper hat and living with your parents.

I thought I saw that picture before and now I know where. Tsk tsk.
How much does a site cost to get running, maybe $500 for a good one including the first year of hosting. I personally believe that your better off having no site as opposed to a bad one, that’s probably why I am just launching my first one now. It's good to take some ideas from other sites but not actual content at least without permission. Heck is that really what you look like or is that picture stolen too? |

Wow...this is interesting...
Stollen pictures, stollen text, Huggies Banners, false review consipiracies... It's like a hijacked ad for a "New Mother's Weekly" magazine! This thing really needs to be taken off and you should start from scratch. MAN! |

I have done a few designs for other magicians for that price $500.00 and that includes a year of hosting and a content management system that they can edit the site. I have always been willing to help out, all you have to do is ask next time. That is what these forums are about... Magicians Helping Magicians.
I have used text and wording from other sites but not word for word. Example Party tips. Images of someone elses show is a NO NO. I know that if you took images from Getty Images and used them on your site and they found out... Ooo my... they will go after you for $5,000+ per copyright image. That could add up. I am not sure what you were thinking. You see me here all the time and didn't think I would noticed. When someone post about their website I love to review and give feedback since I have years of experiance in it. Just crazy someone would do that. Like Mr. Gump would say Stupid is as Stupid does. Guys thank you for advice . B-rad I am truly sorry I was not aware that was your content. I had asked my dads friend to help me out a little bit and if he could write me a paragraph for my home page . I guess he took the easy way out . I'm truly sorry and would never steal anyone's work . Last time I trust someone with my website .

Thank you Jerry for the post and removing the images. I have PM you about this.
Just be careful in the future it could have cost you a lot more then to hire someone to do it. Hire a professional in the future for your website. When someone says that will do it for free... you are getting what you paid for. This goes to say with anything in life. Cheers, B-Rad

You know... some of you attacked this kid (note, if you are under 30 you are a 'kid', unless you are a female over 18, then you are a woman) without finding out the facts. While I don't approve of someone using others material it is very common, in particular 'party tips, where folks will change the verbage by a word or two and think it makes it original.
What do you think is going to happen outside the magic world? Do you think Rosa Gonsalvez in South Beach who is looking for a magician for seven year old Bills birthday is going to go look at a site for a Vegas based kids show magician as well and then say to herself "Goodness, the photos look the same and the verbage as well, I believe I must find out who was first so I know if I should hire local guy Jerry of fly in Brad from Vegas if he is willing to reduce it from the rate of $100 I'm willing to pay". Pulleaze. Then only one person questions the guy who says put in fake comments! Jerry, straighten out the site, fine tune it, get hold of info on how to get your site found when locals search, and have fun and make a few bucks. Just a tip, if you want to know how your site looks don't ask magicians, what do they know? Nuttin' I tell you. |

I do agree that some people went a litle over board (Don't think I did...did I?). But MagicSanta, do you know for a fact that Jerry's fathers friend really put the website togerher? Just something to think about..but anyway, the only thing that matters now is that Jerry did the right thing of taking the images and text that was taken from Bradley's website. I'm glad for both of you this was resolved.

Magic Santa
This had nothing to do with me being booked there or here. This has everything with the images that are my copyrighted property. I am not only a magician but artist, designer, and photogher and know my rights. I have been doing this a very long time and do well at it. Here is something all should read on the topic of photos on the web. http://www.techsoup.org/learningcenter/internet/page5970.cfm This is about borrowing images on the web. This will educate you on what is safe and what is not. Again if you took images from Getty Images or Stockimages without paying you could be subject to fines of $5,000+ per image. They don't care what your story is, they would go after you. I asked Jerry to remove the images. I have resolved this issue with Jerry and provided some help. I have also offered to help him in the future if he needs it. When Jerry completes his site he should post it again so that we can give him the tips that he needs to make his site great. Cheers, B-Rad

because I knew he was artistic and creative . Now you know that he is not! I'm surprised at Santa's response. Even if your friend's dad DID do your homework, I mean website, you knew that the photo was not a photo of one of your audiences. I actually think a photo of a happy, smiling audience is the same as a review. It should be truthful. People looking at your site are going to assume that these are kids watching YOUR show. It's dishonest to use a photo of someone else's audience. I don't care how old you are, you should know that. |

Brad, you were the only one who should have been miffed, so behave or I'm on the road, next own over is freakin' Vegas baby...well, next town four hundred miles away.
I'm surprised myself James. I like this guy though and while I think there are a pack of posers running around I think he is really trying to get something going. He knows he shouldn't take photos and got caught with it and he learned from it. There was no harm is what I was saying and he amended it. I hope he has great success as a magician. Heck, there was a guy on here and another site who stole the entire content, I mean every word of text was stolen and then he declared he was totally right to do so! That isn't the case here. All I know while some people are slaving at making a magical website and never will perform this kid is out there trying. By the way, James Munton is the only guy I know of on this thread who is a worker, everyone may be but James is the only one I know of and I didn't have to go to his site to know it. Rock on chillin' |

To be fair, some of the party tips out there on various birthday magician's websites are word for word from either Eric Paul's "How to be your area's top children's entertainer" course, and also earlier from Bob Markwood's "Poof II You" book.
In Eric's course, he gives you reprint rights to use the tips in your own book for parents, etc. (Now people are using them on their website.) Also, there are some party planning tips in an earlier resource, Frances Marshall's book, "The Happy Birthday Business." But you don't see these as often online. If you're going to use them, at least buy the source material. Then you have more of a "right" to use them on your website. - Donald

I really don't understand why it seems so hard for folks to come up with their own promotional text? surely you can make your own show sound exciting, rather than have someone else just make it up, or "borrow" it? With websites easily constructed free of charge, in a matter of minutes, all that's needed are images and text. Why, oh why, would you choose to use images and text which have nothing to do with your show? Why not spend the two or three hours neccessary to create something original?
And if you can't be bothered to put in the miniscule effort required to create your own website, what chances are there that you'll put any effort into creating your own show? Even though my website is a free one, it has regularly been commented upon; the speed of download, the quality of the images, and the clearness of the text. It costs me just $15 a year for my web pointer. If you'd like to take a look, it's http://www.pottythepirate.com You can steal my testimonials if you think it will do you any good, but in the long run, I assure you it won't. You can't let people think you're a highly regarded performer, and then turn up and deliver a mediocre show. That's the way to make your life hard, hard work, and to have a succession of dissatisfied customers. My advice is to work on your show until it's good enough to bring your own testimonials, and until you have something interesting to say about what you offer. If you've been performing for 8 years, you seem to have very little evidence that in all these years you've delivered more than a couple of OK shows.... :) |

Jerry made a couple of novice mistakes. B-Rad was a complete gentleman, resolved the issue in a win-win manner and moved on. Jerry was man enough to own up, fix the issues and move on. Cheers to you both!

Jerry,
How old are you? I am seventeen, my main market is birthday parties. My site for that is http://www.princesslexiloo.com I am trying to break into libraries so I have a smaller site for that at http://www.educational-magic.com Now, you have to start somewhere. My VERY first site, I believe is still floating out there at http://www.freewebs.com/partiesbyalexa My first run of professional business cards (which I still, unfortunately, use) have pitures of me in different costumes than I wear now, advertising different characters, and the pictures were from just a few years ago but I look very different. I understand working from the ground up and there are tons of adults out there who don't even have their free site yet. My father, who is a magician, ran out of business cards when I was seven and still hasn't gotten new ones. He is a fantastic magician but works for agents, one of whom is me. That's fine, but then he doesn't understand why he can't charge what Julian Franklin does. Of course, I don't know what you charge, I am priced at the top tier of my market, I use a paid assistant, a backdrop, music, a puppet, I do intricate balloon sculptures, full face painting, and have a specialized character, etc. But I didn't always. I think it is great that you are out there and trying to do as good a job as you can do. But don't settle for where you are now. I still have a repeat client from when I was thirteen or fourteen. I charged $75 for a fourth birthday party. Now I charge a helluva lot more, and her daughter just turned seven. I have gotten to celebrate with them many of times. You will loose some people as you climb up the ladder, but not all of them. Don't be afraid to shoot for a professionally done site when you can get one, or to chantge your brand, or to send out a press release, or raise your prices. There is still a ton that I want to change to my site, to my business plan, to my costume, etc. One suggestion I have for your current website that won't cost you any money is to drastically revise your text. I am a creative writing major, PM me if you'd like my help. Or go to my website and give me a call, I'd be happy to talk about it with you. Good luck. Alexa http://www.princesslexiloo.com |
