Ladies & Gentlemen,
I present the following for your input: If an individual performs an effect that was recently released to the public, but has performed the effect for a length of time prior to the release using an entirely different method, is that wrong? Explanation? Okay, here ya go. I have performed an effect in competition,that I developed independently, and enjoy performing. I am aware of the method employed by the commercial effect. The method I use is different in method yet the effect, from a spectators point of view, appears to be the same. Should I contact the creator of the effect and discuss this or simply continue to perform the effect as I created and not be concerned? I do not make my living from magic (I am a RN) and I, simply put, don't desire to be blasted by those who may observe my performance at a convention and accuse me of "copying,stealing" etc. Am I worried about nothing? Anyway, that's it. |

If you invented it, you invented it. Perform away. If someone happens to blast you and call you a rip off, simply inform them that you came up with it independently, but that you're aware of another existing method. If this someone should be familiar with the other method, they will probably recognize that yours is unique.

You created an effect?
maybe a look/feel for a standard effect? A method for doing an effect?

Hi Mr Townsend ~
Actually, an alternate method from the currently offered may be a better statement. The method I employ allows for a more "open handling" of the prop, removing what I feel is the weakness of the current commercial method, prior to production. Also, the method uses materials that one would not normally associate with the production item. I am actually pretty darn proud of it. LOL Tony |

Here's how I am understanding it.
you have developed a new approach to performing the effect. but the effect is actually invented by someone else? or did you completely re-built the effect the someone else invented that helped with a new approach to performing it? I hope that isn't too confusing.

Did you come up with it after the other with it as a template, or did you come up with it without any knowledge of the other? Edit: That may not have been much of a different question...
Magic is doing improbable things with odd items that, under normal circumstances, would be unnessecary and quite often undesirable.

Your first statement sounds as if you were doing this "trick" quite a while before the other came out, but your second statement sounds as if you developed it more or less at the same time?
If you developed it without any prior knowledge of the other effect then my hats off to you! Myself, I would drop that other person a message (not that what you have is illegal) just as a professional courtesy.
