I have no idea who this guy is...he claims to be a magician and ventriloquist from Kentucky.

I got his figure and when it arrived, the shoulders had cracks and the side of the mouth has a crack too...he said it was probaly damahed in transit and he so upset at me because it seemed like I was accusing him.

Thinking its not the guy;s fault, I even gave him a positive feedback.

Then... after awhile...I suddenly had the urge of checking out his original listing andd guess what I discovered in his own listing ...his own photos taken during the auction...the figure already has a crack in the mouth even during the auction which he never mentioned or discribed in his listing.

He can have my money...I don't care. But crooks like this proudly telling everyone he is a magician and a ventriloquist must not be allowed to steal money again. Listing adamged figure but DECLARING the damage in the auction is the right way to do it...so the buyer can bid properly.

Let me put it this way...

First of all, the money is NOT the issue.

2nd...maybe its my fault that I did not study the pictures first before I made my bids...but Im also an Ebay seller and I will not misrepresent a product...so I was under the imression of trust...BIG MISTAKE.

3rd ...when I told the seller about the crack on the mouth he said he shipped it without any cracks...but when I checked his original listing, the crack was there from the time it was listed.

Check out his pictures from his listing...Mike Brose said that the crack is apparent...I agree specially if you know what you are looking for.

4th and most important...I'm not after the money...he can keep it. Im posting this here and in other sites to prevent this magician- vent to do this again...prevent him from selling to a young vent looking for a vent partner only to receive a broken figure after spending his folks' hard earned money.

As Tom said, this is clearly a misrepresenation of the item...good thing his own photos will prove this.

As you say the money is secondary but you should alert both paypal and ebay about a fraudulent action so that this person gets the repremand he deserves. He never should have stated that the figure was like new when in his pictures it clearly shows the crack in the side of the mouth. Don't let him off the hook!!

I actually gave him positive feedback when he insisted that he shipped the figure without any damages...I really thought it was damaged in transit...good thing his own pictures prove him wrong.

On behalf of all my friends who practice vent and puppetry, I would like to thank you for doing the right thing Wanlu. I am a member of the Paypal & eBay community, as are hundreds of thousands, and we all have to take a stand when someone starts trying to skirt around the rules by selling items under false pretenses. I hate it when someone advertises something as new, and I receive it only to find it is obviously used, or as in the case of your figure, damaged from the start.

Im glad it happened to me and to a new vent bug bitten kid...

I already told the seller he can keep the money...

but I still filed the dispute over Ebay and PayPal...but informed them I am not after a refund but just to set the records straight that an item was misrepresented...

Can you believe this guy...PayPal finally decided on my favor and has suspended this sellers account...

He places a misrepresented item in Ebay and he accuses bidders of GREED for bidding I asked for apologies several times and stressed out that he can have the money but PayPal and Ebay will still have to be informed...

He says he does not ship abroad...so I asked him to ship it to Tom Crowl...but the thing is the figure has been damaged EVEN DURING THE LISTING and not in transit...so the argument of shipping aborad or just in the states is not valid. Tom Crowl even told me that the item was not even bubblewrapped when he got it.

The case is an obvious misrepresenattion supported by pictures from HIS own listing that's why Paypal has decided on my favor...I was never after the money...but he did something wrong and must be reprimanded...I feel bad but its a moral obligation to fellow ebayers...

When I hear someone praying to God to curse their enemies, I think of Matthew 5:44 which states, "But I tell you, love your enemies, bless those who curse you, do good to those who hate you, and pray for those who mistreat you and persecute you."

It's a hard lesson. It's not the way the world responds to threats or enemies, but there it is. Let those with ears to hear, hear it.

I never meant harm to this guy...never did I tell him anything about his family nor his life...it was him who wished my family evil things...I strictly stuck in the issue of the figure being misrepresented in Ebay. It was him who cursed me...and when PayPal decided on my favor, all I can think of to say to him was "his own curse was upon him...and that may God have mercy on him."

Im the victim yet I tried I apologize to him several times...I extended my apologies to him because I feel obligated to report the matter to Ebay.

PayPal never asked him to refund...because I told them I am not after a refund but just to set the records straight...

The internet is full of really troubled people. Just let it go. You will never get an apology from this tortured individual.

It's hard to let go this type of insult but we all know you will not be "punished"
by god. You did nothing wrong.

As I said earlier, Wanlu, this same type of thing has happened to me on eBay as well. I didn't just get one threatening letter condemning me to Hades, but about half a dozen ! It took a threat of police investigation for harrassment to make the nut job stop with his barrage of anger.

We who know you all know you are a wonderful guy, and will have a long and happy life with your super family. BTW, I wil be emailing you soon about the next project I have for you
