Dynamike, I have two returned checks on my desk right now, one for $240, the other for $560. I know these will be picked up without going to court. I stopped going to court years ago, it's much easier, cheaper, and better for business for me to collect myself.
Or do you think I should just assume that neither can be collected? Should I not go out of my way to notify them before running to court? I had much rather work with a customer than against them. A couple months ago I had a check returned on a doctor, he had written it on the wrong account. I've seen times that banks made the mistake. Some people forget to make a deposit, some forget about having a bill automatically withdrawn. Some are not notified by the bank until they get the montly statement. Sure the check was returned to Matt because there wasn't enough money in the bank, but she may have an understandable reason for it not being there. She may not know about it, and she may be willing to make it good. All I'm saying is, he shouldn't even think about going to court until he has ASKED her about it first. Making a couple of phone calls is not enough. Collecting is not always easy, it takes time, and if not done the right way can hurt more than it's worth. Tom

If she does not want me to take action, she also needs to attempt to make it good.

She 'owes' you the balance of the cost of the show. I wonder if she offered the amount owed you would still be in a snit over the 'tip'? There are a lot of people who do not take calls from people whos number they don't recognize. You seem like such a likable kid I'm sure your charm will win the day....ha!

I have spoken with her before and left 3 messages on her cell phone. Even if her home phone has no caller id, she has my number on her cell phone.

Sorry I missed the part where you left messages with someone else.
I would get her work number and try there. Next I would send a certified letter. Good luck with it Tom

Tom, Matt mentioned he made more than a couple of calls. He even mentioned he spoke with the female's relatives. He mentioned he called her cell phone, and left voice mail. He tried contacting her by telephone enough times. Matt is going the right path by sending a certified letter next.
If there is an emergency she should tell Matt so an arrangement can be made. She is making it worse for herself if she does not contact Matt. Possibly the female wrote other bad checks. Probably no one took her to court or told the DA. If so, someone has to make her stop, and that can be Matt. If no one take care of what those criminals are doing, the innocent ones will have to pay. I have taken people to small claims court before. It is not as much for the money, it is for the principal. Posted: Mar 10, 2009 11:30pm Matt, I would ignore Michael V. Nevets comments. He just wants to get your attention by getting under your skin because of his own personal problems. |

Oh, he's not under my skin at all. I find much of what he says quite amusing. He thinks he is getting me angry and fired up, he's just wasting his time.

Actually I think he should stop whining here and go file his small claims case and get it over with. He can seize her car or whatever fantasy he has. He hasn't the sense to realize she likely gets paid every two weeks which would make it this coming friday. So go, file, do it for Dynamike, it will be worth it, believe me,to drag her to court.

MagicSanta,
Now you are putting words in my mouth. Like I said before, I only said that that I "read" that the court can seize property. I understand that people get paid on set schedules. She knows what that schedule is and could have told me to wait, or put a later date on the check. Besides, two weeks would have been on the sixth of this month. You really need to stop, you are not offering any useful advice and are only trying to instigate trouble.

No Matt, not every two 'Matt weeks', you see, when big people have jobs they tend to get paid in the middle of the month and the end of the month. It works out well because months tend to have four weeks in 'em, some five, but it comes out in the wash. Soooo, this Friday would be the closest to the middle of the month, got it?
I'm tell you, go on Peoples Court with that sweet lil' judge. She'll let you win, you'll get paid out of the money the other person is paid to be on the show, and you can put on your web site "As seen on TV". |

If there is going to be money in her bank account - this is the weekend it will be there! You may just have a shot at getting paid with that check this Friday. |

Mike and his knowlege of real world legalities (other than as a defendant which I will allow for if he has that experience) is limited by his ability to use google and then comprehend what he has read. So here is the deal, from someone you don't get along with. GET YOUR MONEY FROM HER! I was the one who told you to go to the DA in the first place. I don't feel sorry for her, as much as you for listening to Mike. You earned the money, you deserve the money and are entitled to it and if it worth your time you should then persue it. No problem from me. I think you simply need to go about it the way the DA tells you to do it, as opposed to seeking legal advice from guys who probably didn't finish high school on a magic board. Legal advice from the point of a defendant, may not always be as accurate as you may think. There is NO WAY a judge in the reality we inhabit is going to grant you the right to take away anyones things for a bad check. BUT that being said there are remidies which you can avail yourself. You simply have to figure out if they will cost you more than the check. I wish you luck.

Danny,
I am actually surprised that you made a post that wasn't bashing me or being rude to me. I really do appreciate it. Maybe we could start over, with me saying thank you. Thank you.
