In an ideal world, you're correct, she should have said something at the time, however people have a hard time saying "no" and would rather not deal with confrontation. I just think that the lady canceling his check was her way of dealing with ultimately not wanting to pay. I have an extensive background in sales and one of the things that has always amazed me are people who cannot say no. They never had any intention of buying, but they keep making excuses and leading you on giving the intention they're going to buy. Again, it's people who don't want to deal with it. Regarding the money back guarantee, I always get my check before the show, so they have written the check before they saw the show. There should be something that they request their money back immediately after the show. |

TO begin, yes a 7 minute routine. Was just starting the setup and I had to use to birthday kid sadly enough in this situation. It's full of small gags and what not, one of the better routines I perform. as I begin, 3 minutes in the kid, who keep in mind I just got up on stage with me decides to not want to be up there. Could be bad audience management, or could be a horrible kid.
If she had a hard time saying no, that's fine. But here is what really makes me mad. She called my agent and said " I just want to talk to him, have him call me or I'm canceling my check". This was Monday morning at 7:30 ( yeah she called that early) He called me and I called her back by 8:00. No answer. I left a message. No return, he called her again, no answer. Finally the check is canceled yesterday (Thursday). Also this lady had no idea how to plan a birthday party ( not saying that I'm a party planner). Like I stated above, has 10 kids ready to break a pinata. Gives the first kid a wooden baseball bat. Swing first time, breaks the rope. Dad holds it ( Americas funniest videos) Second kid gets up, brakes the Pinata. 8 Kids standing there bored. To be it seems that nothing went right in her eyes, so she took it out on me. |

I think the government has a bail out plan for this? (Just Kidding) Do you use a performance agreement or contract? If not, start using them. My performance covers everything from bad checks to non-payment to BOR sales etc. It has helped so much to have them sign it. My check policy is local checks only, a $30.00 service charge on all returned checks and all dishonored checks will be turned over to county attorney for prosecution. Our state is very intolerant of bad checks and usually turns them into criminal 5th degree theft charges. I have only ever had one bad check and the woman called and told me it may bounce and if so she would make it good and any charges that I incurred. She did make good on it. I highly suggest using a performance agreement/contract for any performance including birthday parties.

Magicjg, why are you trying to handle this all on your own? Is your agent trying to intercede on your behalf? Seems to me the agent has an interest in this too.

Last year I had a fight with some lady over cotton candy.She was mad I used pink cotton candy at her sons party .I asked why and she said well it is a boys party.You should of used blue do I got to pay for it I looked at her and said you ate it now give me my G*d D*mm money.Any excuse not to pay.Now I get my money before I unload my car
