Good morning
I have spent many hours trying to find a public domain instrumental version of "You'll Never Walk Alone" to no avail. Can anyone help me as I need it for background music for Andre Kole's 3 ball effect.I am really reluctant to be illegal. Thanks in anticipation, Mike |

You can have a choice of many completely legal versions on iTunes for $.99 each. That's almost free...

I'm not sure you will find a strictly public domain version or royalty free version for performance. The song was written in the 1940s. The lyrics and tune should still be under copyright protection. As I understand the law, even if you were to sit down and record your own version it would still not be public domain or royalty free for you to use the tune in a public performance. The person who wrote it (Roger and Hammerstein, their estates and assignees) would still be due royalties. I have never read the fine print on iTunes, but I suspect it will tell you that your purchase of the songs allows for personal use only and that using the music for any sort of public performance would require a separate license. Public domain is a tricky business, but in general terms for materials published by Americans in the USA before 1923 are public domain. This always requires research into a specific work to make sure it's not covered by one of many exceptions. Royalty free collections are generally collections of original music and/or public domain tunes that, rather than paying a royalty every time you use the music, you pay a one time fee and are able to use the music as you see fit or within the confines of a license agreement (I have seen agreements that limit you to a specific geographic area). These are often called "buy out" collections. That's probably way more than anyone wanted to know, but as far as finding a copy of "You'll Never Walk Alone" that you can legally use for a public performance without paying a royalty, I don't think it will happen.

I could be wrong but I do believe it's okay to perform the song in public. Cover Bands in bars do it all the time without a special license. a couple of years ago I approached Apologetix to get permission to use one of their songs in my show. They had no problem with it at all. They are great guys!
It's recommended that you get a legal copy of the song though.

To answer your question directly, there are versions of that tune available at online "royalty free" music warehouses. I found one at stockmusicsite(dot)com [this is not an endorsement]. I googled - royalty free music "You'll never walk alone" You might need to search several sites to find a version you like, or contact one of them for a custom job. To answer the other issue, if you are hired to do a show, it is generally the responsibility of the client/venue to obtain the relevant licenses/permissions. So, if you want to use the soundtrack from "The Sound of Music" in your show, it's OK. If you are making a video for your show for demo or sales, that's a different matter. You will need to obtain the license yourself. Which, if you buy from one of the afore-mentioned sites, will be part of the sale. Wes Holly |

Is it the clients responsibility? if you are coming in as an independent contractor, I thought you had to cover all those type things...
