A meal, if I want one at the end of the shift, and (soft) drinks during the shift are part of my standard contract for restaurants.
I would never even discuss employment in a place where I was filling in for another performer. I'd be fuming if someone did that to me. As for a restaurant offering to raise the rate for a replacement - I don't think that ever happened. |

The other magicians contract was over. It is up to the owner to decide who he wants to hire for entertainment.
Fabio didn't steal anything.

I am surprised how this thread has developed.
I guess I am in the minority here but when I had a band we had drinks AFTER the gig and they were always on the house. When I worked pubs and restaurants I always had a meal after the gig and sometimes a drink with he owner but I guess because very often we were friends. If they were people I didn't know who didn't approach me to work for them I guess I would not have had a drink or I might have taken away my meal but in all the time I did this I never had anyone look at me strangely for eating. Maybe I was too busy woflong down my food to notice!?! I had many "sit down and joke around with customers after my gig" night and many of these turned into other shows and sometimes even into friendships. I think you are over analyzing this. |

I've never had a problem sweetening a restaurant deal with a meal at the end of an evening. As far as I know this has never decreased my percieved value. Maybe it has and I just didn't know it. I have found it rare that I will sit down at my restaurant and eat simply because it is usually difficult to stop performing if I am still there.
I personally have never used a signed formal contract for a restaurant gig that stated within the lengh of my engagement(3 months, 6 months, etc). I guess if I lived in a resort town, there would be a need for a restaurant to want one. I've been fortunate enough to have worked as long as 11-years at one location and unfortunate enough to have stayed less than 5 months when I learned that when a restaurtant's management changes, often, so does its choice of entertainment. The way I see it is that even if I had had a signed contract with the former manager, what good would it have been? If Fabio took over a friend's gig that had just expired, then great. If not, well then it has already been covered. |

He had not finished his contract with the restaurant, at least in his mind, since he got Fabio to fill in for him so that he wouldn't lose the restaurant. As Fabio says, he didn't want the restaurant to tell him to "take a hike" for not showing up for his regular gig. Secondly, this restaurant spent 6 months "testing" the magician by offering him meals after each show? And we're supposed to believe that after 6 months of "failing the test", the restaurant still hadn't fired him? Several questions arise for me: If the magician hadn't given up the restaurant gig that night, would the restaurant keep testing him for another 6 months? If Fabio becomes the new resident magician for this restaurant, what kind of hidden test will he be subjected to? Why would a magician want to work in a restaurant that does sneaky and underhanded games like this on their workers? Makes me go "hmmmm...." Brian |

They had both (Performer and Restaurant Owner) signed a contract for a 6-Month period, and the contract had already ended. The restaurant kept asking him to come by for whatever reason, and as far as I know, his 'how about a free drink?' behavior wasn't from his first show on. And, hey, nobody's supposed to believe, agree, disagree or whatever about my POV. |

I don't understand why you would give an extra half-hour for free. It's basically undercutting your friend. You're working for a longer period of time for the same price, hence you're cheaper. My opinion is you ask for a letter of recommendation from owners there for aonther restaurant and allow your "friend" to keep his gig. Just my opinion of ethics in restaurant magic. I've filled in plenty of times for buddies of mine in restaurants. I actually ended up taking over a restaurant for a friend after he OFFERED it to me, but I would never accept a restaurant gig like this without talking to my friend first. Think about many future possible gigs he'll never ask you to sub.
