The greatest trick will be doing it without Disney suing you down to your last nickle. They are VERY protective about their characters, and pretty vicious about it.

Do a generic audiece participation effect and use volunteers with (official) mouse ears on.

I totally agree, you are asking for trouble from Disney. They are VERY protective of their images & products.

While this won't help you directly, I thought I'd share this as it is one of the most ingenious uses of Fair Use with a company that is so 'anti-fair use'
http://www.youtube.com/watch?v=CJn_jC4FNDo Not only is it well done, it explains quite a bit about copyrights and what can and can NOT be done with protected works. |

Ok, that was the hardest thing to understand...does somebody have a transcript?

Here's my take on this. Involve patter and familiar (non-copyrighted, but more like symbols) objects into your show. Make it fun, magical, and memorable. And be upfront with the parents that you respect this particular corporation and therefore don't provide a mickey themed show, however you will incorporate the child's interests into the show and everyone will have a great time.
Dress the kid up like a wizard ala Mickey...give them a magic wand and tell them that is your particular mouses' wand but he always lets the birthday boy borrow it for the ultimate birthday magic test...etc. You can do the right thing and make your client happy--the possibilities are limitless, with a little creativity. Creativity...that's really what they are paying you the big bucks for, innit? My thoughts. |

Yes, the House of the Mouse is EXTREMELY proactive in guarding their copyright -- there is an indoor mall near me that received a 'cease & desist' order regarding their illicit Disney-themed mural on the building's exteriour. But legal questions I leave to others.
Do a paper tear, with the final reveal showing a well-known silhouette with very prominent ears. This bit is nearly always my finale, though not always showing a lovable rodent at the end. Leland |

Here in RI, we have the Modern Diner, a beautiful, archetypal 1940s diner. A few years ago, the Diz put it on a T-Shirt without so much as mentioning it to the owners. Owners found out, sued ... and won! Disney coughed up "an undisclosed sum."
So while they're pretty jack-booted in defending their copyrights, they'll apparently make free with anyone else's .... Rory

In practical terms, I'm sure you're alright if the only "theming" material you use is bought from Disney: authorized and licensed mouse ears, etc. - it should be stuff the parent bought for the party. In other words, if the "mouseness" comes straight from Disney and all you do is refer to it, or make volunteers wear their mouse ears, or call one volunteer "Mickey" and the other "Minnie".
Once you would get into advertising a Mickey Mouse magic show, or otherwise trading on Disney themes, then you're on dangerous ground. My ideas: if you have a sucker trick, at the end proclaim the volunteer to be "Goofy". If the family dog wanders in, tell the kids it's Pluto in disguise. |
