What are the legal issues surrounding busking(in Manhattan)? Like I know you can busk, but do you need some sort of permit or something? I've taken a look at this site http://www.citylore.org/citylore_links-guide.html#factcheck
but I don't know if that applies only to musicians or if its a blanketing kind of thing.This would be my first time busking I would ask you guys first to see if have a more direct answer. I'm likely to do it anyways and just take my chances, but it'd be cool to see whats what before going out. thanks in advance! Paco Iglacias |

To find the real answer to this you probably should see if you can find a lawyer that passes the hat for his fee.
Seriously, even if this is true, you probably can't quote this page as an affirmative defense if you get a citation.

Oh I would never think of such a thing. That's like saying "But officer, the internet told me it was illegal not to drive drunk!" I figure my best bet is to just leave if asked, most cops aren't jerks unless provoked and usually have leeway when it comes to that kind of misdemeanor stuff(you know, depending on how much you annoy them).

This is really good thinking. The most important part of any performer's job is to make the spectators like him. This includes the police. It also includes any merchants that might be in the area.
In several of my posts here, I have referred to the busking marimba player that I saw on the Stachus in Munich. He was very careful not to block the traffic to the merchants too much. He made it a point to let his crowd know that they needed to be courteous to the shoppers and the shops. I felt this made him more likeable, and it made people more inclined to put money in his hat. The fact that he was an excellent musician didn't hurt, either!

Most cops do not fully understand the laws pertaining to busking, because it's very rarely a situation they encounter.
Many will attempt to lump you in with "unlicensed vendors" -which is mostly illegal, unless they know differently. Not all of them will. Know the law, heed the law, have copies of the relevant ordinances with you if you suspect you'll be hassled, ...And always let The Filth know that you're ready and willing to cooperate with them in every way possible (including giving up and moving along).

When push comes to shove, it's best to do neither. The guy with the funniest hat will invariably lose a confrontation with authorities. Get aquainted with them if possible and be helpful.

When I visited Manhattan I asked several police officers in Manhattan about this. They all said the same thing: if you have any sort of amplification, you need to get a permit. Otherwise anyone can perform as long as they don't block traffic.
You can't do it in Times Square. There you need a permit. Anywhere else is fine. IF you get asked to leave and won't, they arrest you. Then before the judge you can show all the documents in the law saying you have the right. "Mayor Fiorello La Guardia banned busking in New York on the grounds of safety issues regarding the escalating conflicts. Busking went on, but on a much smaller scale. If anybody complained about a busker, at their discretion the police could order the busker to move on or could even arrest him or her. In 1970 poet Allen Ginsberg challenged the constitutionality of this ban. The ban was lifted in 1970 after being found to be unconstitutional by NY Mayor J. Lindsay".
