I need help guys. I think I finally have an idea that I want to put together and market which is finally something new. However, I'm pretty sure the basic concept of what I'm working on has already been performed on television. (I want to keep this very vague, because I'm just asking about any effect in general.) The effect that was performed on television was never published. However I feel that it might be the same method. I tried my hardest to re-create what I witnessed, and now I feel that the "core" of my method is probably the same method this gentleman used. What if I decide to do a DVD, or book, containing this effect? Can I get in trouble if the method turns out to be the same? Or should I be just fine if I mention this performance as "inspiration"? I hope that makes sense.

Sounds like some due diligence is still required. You could try and track down the performer that did it on TV, or alternatively seek out somebody knowledgeable in magic history. I know magicians like Jeff McBride, Max Maven and Joshua Jay have helped other magicians research products before releasing them.

BTW, in the magic biz, we call this "using a red silk instead of a blue silk."
If you plan to release someone else's material, get permission first and credit them on the DVD.

You don't understand. It's a torn and restored card effect. There are already 20 methods in print. I know that the concept isn't new, of course. It's the method that I think might be new.
