Any one have any experience getting back your web site after it expired?

(Posted here because this is where the techies seem to be.)

My site came up for renewal and because it was "locked" the only person who could renew it was me - but because I moved net sol would not accept my id (catch 22).

A squatter was in the wings waiting to take it - they did - and I'm wondering if anyone has dealt with icaan - who is the governing body on ownership?

Jay... I'm so sorry your going through this..

You need to go through ICANN Arbitration or Buy it from the new owner..

for arbitration you have to have the site trademarked and meet these requirements

The domain name must be identical or confusingly similar to a trademark or service mark in which you have rights.

The current registrant must have no rights or legitimate interests in the disputed domain name.

The domain name must be being used in bad faith.

Filling can get very expensive (The one I did about 8 years ago was $1500, a competitor bought the domain name and used it to talk bad about us, we won)

Another Option is if they are using your old website design and just adding links to it (I have seen this being done A BUNCH with drug ads) is to file a DMCA infraction demanding the registrar delete the domain allowing you to re register.

and the option I hate is negotiating to purchase the domain back (If the person who bought it offered to sell it to you 1st then you will probably win arbitration)

4th option and not a good one..
register a new domain NOW and call me I will help rank multiple pages of the new site for you old domain name so you can get some of the traffic back. and get up again quick..

So It's better if they contact me first? What if they don't? What If I wait another week or so, won't it look like I don't care so they won't bend me over a barrel? (They don't want to get stuck with the name either)

A good buddy in Michigan had this happen to him. The site was in his character name. The buying entity was a porn site targeting teens. It caused him a tremendous amount of embarrassment and lost business. Protect your domain names, guys!

Skip your friend would have been able to get it back through Arbitration..

Jay if they contact you to sell it back to you it makes it EASY to prove "Bad Faith"

but I would go ahead and try to contact them and work something out as that is the easiest way to handle things..

Mike, I believe he did eventually, but it was a costly and tedious business and his rep was damaged considerably. The point was to monitor those domain name expiration dates and subscribe to auto-renewal systems to keep possession.

Normally these cybersquatters who steal your domain will not contact you - they wait for you to contact them (they deal in volume usually...)

Going price for getting your domain back is $10,000 USD. Probably not what you want to hear. Easier to start with a new domain. (And cheaper too!)

Yeah for what it would cost many times to get your domain back you can build out a new site and take over Google for your keyword strategy

It costs about 9 dollars a year, but regardless of where you get your hosting, get your domains via GoDaddy and pay the extra for private registration. They'll put your domain into domainsbyproxy or wildwestdomains, which don't report the same information the icaan would like. Protects your domain with no fuss or crazy paperwork.

Jay, as soon as you're able to, I recommend ceasing business with network solutions. There are plenty of other good companies out there that are much easier to do business with.

Nothing was stolen here. The domain expired... someone else registered it. At this point, any "intent" the new owner has is just conjecture.
