Because most people don't have the muscle mass to throw it off at the low end, and the math is really simple, requiring only two variables. You can check it with just a scale if you know your height. Of course it's really inaccurate, but tell that to an insurance company that adjusts rates according to the number.

Because it's more efficient for individual artists to assign the rights to the BMI than it is to license their works themselves. Especially since the BMI has greater resources to detect infringers and enforce rights.
