This can’t end; I followed this thread with great interest and was on my way to suffering a brain hemorrhage because of confusing conversation, boasting, bluster and harangue. Hopefully (not really) the package will get lost, it will be received broken so this discussion can move to the next level and it will continue. Then It can be decided who to blame and who to take legal action against next, the post office or the guy who sent the package. |

Well, the question turns on what condition the goods were in when handed over to...
Oh, never mind. I think I'll go back to practising my ring through rope trick. Let's see, the rope goes where? :)

Funny you should mention that. Her eis my situation since we have resolved this one.
I had a DJ system shipped to my house. It is in perfect shape as it is new. SO the UPS guy tries to deliver it, and we are not home. He calls and says "well can you meet me" so he doesn't have to unload it at the warehouse, and reload it on Monday. I have a mustang and NO WAY is this stuff going to fit. He says to me that he hopes nothing happens when they load it and unload it in an attempt to get me to pick it up somewhere or whatever. My response was "we bought it pristene and if it is otherwise when we receive it, UPS will be paying for it I guess". Am I right?

UPS has to deliver it without damage, or they pay if they caused the damage, I have never heard of a UPS delivery person loading and unloading a truck; the union contract does not alllow the dirvers to do the wharehouse worker's job

All UPS damages are limited to $100.00 whether lost, stolen, or damaged. The originating party must purchase insurance in excess of the $100.00 prior to shipment. The $100.00 is noted on the reverse of their shipping forms.
I speculate the driver is implying that someone will unload the item. He doesn't literally mean himself. There are sorters at the local final sort facility, but drivers/delivery personnel oft times help to unload items. Union mandates do not forbid drivers from unloading their vehicles at sort. Loading is performed by sort personnel, unloading is oft times performed by the delivery agent/driver. In this case the box would not be unloaded at the sort facility. Undelivered items remain on board the delivery vehicle for two more attempts prior to any return process. When you receive any shipment, be sure to check the box contents with the driver present, note any damage, if damage is found, contact the manufacturer or supplier for any damage claims. The onus rests on the originating party not the recipient. It seems that you are speculating damage. Why raise the issue, if it hasn't occurred? I have handled literally hundreds of damage claims on behalf of clients. I have some very scandalous stories that UPS does not want divulged. They paid heavily for our discretion. The 'issue' first of all was more of a joke than anything. Second of all the DRIVER was the one who said they had to unload, and then relaod them and it might damage the boxes. So I WASN'T the one who raised an issue that didn't happen.

Hooray! The props arrived today. Funny enough I was missing the short rope from Professor's Nightmare (no joke). I'm thinking about suing the guy that sent my stuff back to me for $1. What do you think?
Danny I think you should file a preemptive lawsuit. Don't forget punitive damages, loss of income, and emotional distress. You might be able to get some alimony if you have a good lawyer. Seriously though, lesson learned. Thanks to everybody for their advice (right, wrong, or indifferent). Joey D |

Hmmm, UPS just delivered some DJ equipment to my house. There was a little piece of rope mixed in with the packing material. I tossed it out.

I did not read the other comments I just scrolled to the bottom to share my thoughts. First, it is important for you to always remain in control. It seems like the event got a little hectic and they began dictating what you should do and where you should do it. Always, always, always pack up your stuff before you relocate if there are multiple performers involved.
I am in no way justifying what went on after the event at all. Just take it as a teaching moment so it doesn't happen again. Never leave your stuff on stage unpacked. You can be polite and let them know you will move off the stage after you have gathered all of your props and packed your cases. Just my two cents worth if it's worth anything. |

Sometimes it actually pays to leave something behind by accident. I recently worked a busy fall festival show and left my promotional display board behind. The Youth Bureau Director (who was too busy to speak to me for any real time) called to let me know he had it and that I could pick it up the following Tuesday. I ended up speaking to him for a while that Tuesday, giving him a bunch of promotional material - as he was heading to a meeting of all the area youth bureau directors the following day so they could discuss (among other things) entertainment suggestions. I have already received several opportunities from the other towns.
