Giving false information to the police can often be considered obstruction of justice. Hard to believe that this doesn't also apply in England.

Or perjury...certainly in federal immigration court proceedings, one's identity is a material fact.

If someone is caught shop lifting and admits to being a 21 year old illegal immigrant, I'm kinda inclined to believe them as there wouldn't seem to be a lot of motivation to tell the lie. And if she didn't want to be deported, she could have always decided to tell the truth at some point. So, GDW, I guess we're back to she got what she wanted. I'm a bit confused as I thought you were all for freedom. I have a little more sympathy for the family, especially after raising a few problem teens of my own. While it's true that the parents should have ultimate responsibility, there's only so much they can legally do. You certainly can't physically restrain your kids without putting yourself into danger of the law yourself. |

A new name is not "false information" it is simply your new name.

Intentionally provided a false name to law enforcement or the courts is an offense in most jurisdictions, including New York. Any lawyer, which you clearly are not, can tell you that. You're not going to get very far in your defense by telling the court that you simply picked a new name because you didn't like your old one. You cannot change your name if your purpose is to deceive, mislead or otherwise commit a fraud. You have conveniently overlooked that. Yes, if you just decide to start using another name for the heck of it, that isn't a crime. You will, however, find it nearly impossible to obtain new legal ID without filing for an obtaining an official name change. So good luck in flying anywhere or getting a license, etc. But the current discussion is about using a false name in order to mislead or interfere with an investigation. That is an entirely different matter. Good thoughts, Bob |

The kid did wrong, but I think the law punishes the bartender that was responsible. I've heard of runaway minors in the past give false names. I think it is almost standard procedure for runaways. But I've never heard of a runaway minor being deported as a result of that. From the story, it sounds like the girl might have wanted to go to Colombia. It even sounds like someone (maybe in the drug or sex trafficking world) gave here the name of someone to use, that would ensure that she was deported. I have to think that the authorities dropped the ball here. They should have checked the identity and fingerprints. Especially when dealing with someone so young.
